Workplace Discrimination Based on Pregnancy

- Description: In the past, South Africa was marked by widespread discriminatory practices, many of which still exist to date. This study investigates the persistent discrimination against pregnant women. The study revealed that in South Africa, pregnant women continue to face discrimination in employment and are often denied the right to go on maternity leave, nursing or breastfeeding and childcare facilities. Presently, pregnancy is listed as a prohibited ground for discrimination in the South African Constitution as well as many ILO Conventions. Similarly, the South African labour law framework which gives effect to the Constitution provides for the protection of women and pregnant workers. This protection comes in the form of measures that proscribe dismissal and discrimination based on. Despite these legislation, this study finds that the less favorable treatment of women and pregnant workers in South African workplaces has become increasingly common, and this has turned into a contentious subject. This study focused on labour legislation that has been developed to safeguard pregnant women in the workplace in light of applicable constitutional protections. Notwithstanding these legislative protections for pregnant women in the workplace, the analysis shows that many pregnant women continue to be treated unfairly due to their pregnancies or for reasons linked to their pregnancies. Consequently, there has been a regression in the actual execution of laws and regulations protecting pregnant workers. The study highlights the need to establish mechanisms to ensure that legislation protecting pregnant workers in the workplace achieves its intended purpose and is implemented properly. Nevertheless, poverty, inequality, and unemployment pose the greatest threat to human dignity and social cohesion. Section 27 (1) (c) of the Constitution obligates the state to develop a comprehensive social security system. It affirms the universal right to access social security, including appropriate social assistance for those unable to support themselves and their dependants. It orders the state to take reasonable legislative and other measures, within its available resources, to achieve the progressive realisation of these rights. The underlying normative commitment of social security is the improvement of the quality of life of the population by promoting economic or material equality. The study provides a general overview of the system of Social Security in South Africa as a Member State of the ILO. In particular, the study underscores that South Africa has not ratified ILO Convention No. 102 Social Security (Minimum Standards) Convention, 1952 and other Conventions relevant to Social Security. The study examines the need to ratify the said Convention in order to receive extensive coverage that would, among other benefits receive guarantees for a well-established system and thereby potentially reduce poverty. The Constitution is the supreme law of the country, it clearly stipulates that when interpreting, and applying the statutes international law must be considered. The study illuminates the significant benefits the country would receive from ratifying Convention No. 102.

- Description: The aim of this study was to analyse the effective implementation of affirmative action. In South Africa. Affirmative action is seen as a means of correcting historical injustices and levelling the playing fields to enable all South Africans to gain equal access to opportunities from which they were previously restricted. This study observed that even though South Africa is now governed by a new democratic order historical workplace inequalities exists which still need to be addressed. Further it was noted that not only compelled to redress inequalities by the Constitution, the South African government was motivated by the ILO to enact laws that would prohibit discrimination and promote the economic advancement of the majority. Therefore, in an effort to narrow the gap between previously advantaged and disadvantaged individuals, the government passed a series of employment laws mandating, amongst other things, affirmative action. By doing so the South African government sought to ensure that all employers are compelled to take positive steps to redress disadvantage and inequality. Be that as it may, the study revealed that affirmative action is theoretically justifiable and has an important role in the achievement of equal opportunities and equality of outcome but in practice, various problems exist. Generally, the study reveals that notwithstanding the legislative framework of affirmative action in South Africa, inequalities continues to exist in employment, a clear signal of inadequate implementation of affirmative action. The study reveals that black people, women and unable persons are identified as primary victims of workplace inequalities. Continuity of work inequalities are statistically portrayed graphically in this year’s (2017) Quarterly Labour Force Survey (QLFS) conducted and published by Statistics South Africa on the Economically Active Population (EAP) still indicates no confidence to implementation of affirmative action measures nationwide. Reviews of implementation of affirmative action, recruitment strategies, retrenchment plans are strongly proposed to combat controversies and challenges surrounding the implementation of affirmative action. A sunset clause is highly recommended to projectize affirmative action. Similarly, with determined advocacy for affirmative action, the study anticipates progressive equality and sustainable justice in South African employment in the immediate future. Chapter five of this study recommends remedial measures to address the challenges and impediments for effective implementation of affirmative action.

- Description: This treatise examines the challenges faced by people with disabilities, in particular, dismissal and discrimination at the workplace. The study employed a qualitative approach to explore and address the research questions. It highlights that the Constitution provides protection against discrimination on the ground of disability. This right not to be discriminated against or unfairly dismissed is further given effect by the Codes of Good Practice in both the EEA and the LRA. Dismissal on a prohibited ground of discrimination, such as disability, is not merely unfair, but automatically unfair. Despite the above legislative protection, the findings in this study indicate that South Africa still faces huge challenges of disability discrimination and dismissal. Notwithstanding the increased sensitivity of this subject across the country, applicants for work and employees generally find themselves to be the victims of employment discrimination as well as dismissal due to their disability. Those who are in the working sector are not reasonably accommodated. The study submits that people with disabilities should be reasonably accommodated and be retained in the working sector as they have a positive role to play in the economy. In terms of legislation, the study found that although well written in theory, they are practically ineffective given that they are fragmented. This study observes that single legislation dealing comprehensively with disability management, like in other jurisdictions does not exist in South Africa. The lack of such single legislation is a significant weakness in the South African disability management framework. Therefore, this has resulted in a fragmented approach to implementation. The study suggests that trade union representatives and employers should be well trained, particularly on issues relating to dismissal for incapacity in general. From a global perspective, international organisations through ratifying Conventions have also heeded to the plight of disabled persons. This is proof that disability can no longer be confined to the borders of one nation. Many disability organisations have emerged over the years and are representing the interests of the disabled. The findings of this study may help companies, organisations and institutions improve their policy practices regarding the dismissal of employees associated with ill health or injury.

The enforcement of settlement of agreements and arbitration awards

- Description: The Labour Relations Act (LRA) recognises settlement agreements and arbitration awards as mechanisms by which the rights of parties in troubled employment relationships can be asserted. Commission for Conciliation Mediation and Arbitration (CCMA) is a statutory body empowered to make and pronounce on such rights through settlement agreements and arbitration awards. The CCMA caters for those earning within the stipulated ministerial threshold falling outside the existing bargaining forums. However, not much empirical evidence is available to indicate the challenges experienced by parties when attempting to enforce those CCMA rulings to get defaulters to comply. South African law accepts settlement agreements as part of dispute resolution mechanism, but the experience of some who hold settlement agreements is such that they are exposed to prejudice when they are required to have the settlement agreement converted to arbitration awards which essentially requires alteration of the very settlement agreed upon. The broad objective of taking matters to the CCMA for resolution with the possibility of having them resolved at conciliation phase cannot be achieved if a settlement agreement is not worth the paper written on and must be made an arbitration award for enforceability. The two are not the same, nor should they be made to be and trying to give them a similar status for enforceability purposes brings about a myriad of unintended challenges. While it could be argued that there also exists section 158 (1) (c) of the LRA if the requirements of section 142A are challenging, it could also be said that such a provision is inaccessible to indigent individuals who may only be able to invoke that provision at the mercy of legal practitioners willing to take cases pro bono for those parties to even stand a chance at enforcing compliance with a settlement agreement that was entered into voluntarily. Such a system allows for employers to bail out on settlement agreements without consequence make a mockery of the CCMA. To a serious degree, this suggest lack of certainty on the part of CCMA and its ability to bring matters to finality which is an important element to realisation of justice. This study sought to examine the way settlement agreements and arbitration awards are enforced, with dedicated focus on the requirement that must be satisfied in order to have force and effect. With the above in mind, chapter one dealt with how settlement agreements and arbitration awards are given force and effect through the LRA as envisaged in section 142A. The chapter explored challenges brought by the enforcement process and what that may mean to the objectives intended by the legislation. Chapter two encapsulates the framework under which the CCMA operates and enforces its decisions, a framework envisaged to be less formal and non-legalistic for the expedient resolution of labour disputes. Chapter three touches on the challenges met with section 143 implementation and highlights some case law prior and after the LRA amendments. Lastly chapter four looked into the enforcement of international or foreign arbitration awards within the South African context given the affiliation with international organisations such as International Labour Organisation (ILO). The chapter explored challenges brought by the enforcement process and what that may mean to the objectives intended by the legislation. Chapter two encapsulates the framework under which the CCMA operates and enforces its decisions, a framework envisaged to be less formal and non-legalistic for the expedient resolution of labour disputes. Chapter three touches on the challenges met with section 143 implementation and highlights some case law prior and after the LRA amendments. Lastly chapter four looked into the enforcement of international or foreign arbitration awards within the South African context given the affiliation with international organisations such as International Labour Organisation (ILO). Also, establishing proper workplace dialogue and forums would assist employers in becoming aware of employees concerns. This would thereby prevent strikes, as problems can be dealt with beforehand. The findings above informed in the recommendations at the end of the study.

A comparative approach is adopted, which relies on primary and secondary sources of data, thereby undertaking an in-depth content analysis. The study provides a comprehensive discussion of the current legislative provisions and alternative dispute resolution (ADR) framework as recognised in both countries' national labour legislation as well as in a number of international labour standards instruments. In particular, the study illuminates and discusses the bottlenecks in the current Kenyan system and argues that it does not adequately respond to the needs of parties in terms of the international labour conventions. The study argues further that labour disputes should be resolved as quickly and informally as possible and at the lowest level possible. Similarly, disputes should ideally be resolved with little or no procedural technicalities, and without allowing them to drag on indefinitely. However, this study observes that there have been notable concerns in the current dual system of labour dispute resolution in Kenya. The problems include protracted referral timeframe for dismissal disputes, non-regulation of maximum timeframe for the agreed extension after 30 days conciliation period has lapsed, the absence of a statutory timeframe for appointing a conciliator/commissioner and arbitration process under both the Labour Relations Act, 2007 and the Employment Act, 2007. The study argues for Kenya to incorporate provisions in its labour laws of a proactive and expeditious dispute resolution thereby helping to resolve labour disputes in the most effective and efficient manner without necessarily having to resort to the courts. Likewise, the responsibility of resolving statutory labour disputes in Kenya is still heavily under the control of the government of Kenya through the Ministry of Labour. There is still no independent statutory dispute resolution institution (Conciliation, Mediation Commission) as envisaged by the Labour Relations Act, 2007. As a result, the Kenyan dispute resolution system has been criticised for lack of impartiality leading to the increases in strikes and lockouts. Similarly, it has made the attainment of effective and efficient labour dispute resolution difficult. In view of that, a comparative approach with South Africa is adopted with a view to informing Kenya how the establishment of independent institutions similar to the Commission for Conciliation Mediation and Arbitration, Bargaining Councils and specialised labour courts can lead to effective dispute resolution in Kenya. Given above, the study provides a wide range of remedial intervention intended to address the gaps and flaws highlighted in the study. Systematically, the study provides important suggestions and possible solutions for a better institutional framework and processes to address them. However, the study acknowledges that making effective and efficient labour dispute resolution a reality calls for renewed commitment from government and social partners and investment in appropriate human and financial resources. This requires a strong political will as well as concerted efforts from all role players in the labour relations community in the two respective countries.

- Description: Providing adequate sanitation facilities for the poor remains one of the major challenges in all developing countries. In South Africa, an estimated 11,7% of the schools are without sanitation. The South African government has a constitutional responsibility to ensure that all South Africans have access to adequate sanitation. When sanitation systems fail, or are inadequate, the impact of the health of the community, on the health of others and the negative impact on the environment can be extremely serious. In rural South African schools, many Enviro-Ioo toilets are available today. They are designed to suit a variety of water scarce areas and where there is a high risk of contamination of ground water resources. It is important to realize that any Enviro-Ioo system programme requires an education programme to ensure that the principles of use and maintenance are clearly understood by the user group. Their maintenance requires more responsibility and commitment by users. This study is an interpretive case study that indicates how sanitation in a rural Ramashobohle High School in Polokwane municipality was managed through an EcoSchools Sanitation Community of Practice, and how this developed action competence for sanitation management in the school. The study established that the earlier practice and knowledge of the Ramashobohle Eco-Schools community of practice exercised in maintaining Enviro-Ioo systems was inadequate; unhealthy and unsafe according to the data generated through focus group interviews, observations, interviews, action plan, workshops and reflection interviews. The data generated also indicates that the Eco-Schools community of practice was not committed to maintaining sanitation in their school because they were not sharing sanitation knowledge; they were not communicating and not updating one another concerning Enviro-Ioo systems maintenance as they had no adequate knowledge as to how to maintain the facilities; and the school management was also not supportive and was not taking responsibility. The study shows how this situation was turned around as an Eco-Schools Sanitation Community of Practice focussed on developing action competence in the school community. It provides a case based example of how knowledge and action competence, supported by an Eco-Schools Community of Practice, can find and implement solutions to inadequate sanitation management practices in rural schools, and shows how members of the school community can be engaged in learning how to manage and maintain school sanitation systems through a participatory process that develops action competence. The study points to important dimensions of developing action competence, such as providing knowledge and demonstrations, inviting experts to the school, involving learners in observations and monitoring and in ensuring that adequate facilities are available. In particular, a workshop conducted by Enviro-Ioo consultants, organised and supported by the Eco-Schools Sanitation COP, together with a follow up action plan, provided the main impetus for changes in practice in the school and served to support action competence development. Finally the study provides research findings and recommendations for further research.

The main aim of this study was to develop a behavioural model for promoting physical fitness and healthy lifestyle of primary school learners in the Eastern Cape Province in South Africa. The first thing was to determine their physical fitness level and body composition then develop a behavioural model based on the findings. The study was conducted in three phases. A quantitative, qualitative and theory-generating research design was conducted using questionnaires, deductive and inductive strategies and literature triangulation. The study involved primary school learners: 356 boys and 520 girls aged 9-14 years old, who were randomly selected. Anthropometric assessments were conducted using ISAK (Marfell-Jones et al., 2006) and EUROFIT (1988) test batteries.The following measurements of body mass, stature, skinfolds (triceps and subscapular), waist circumference and gluteal were taken. The percent BF was calculated from a sum of two skinfolds (triceps and subscapular), using Slaughter et al.‘ s (1988) equation to predict body fat. Physical fitness measurements included sit and reach, push-ups, sit-ups and a 20 metre shuttle run. Physical activity level and sedentary behaviour were assessed by means of self-report questionnaires. Demographic, psychological and environmental variables were also measured by a self-report questionnaire. Six focus group discussions were conducted with school learners. The physical fitness levels were categorized as hypoactive, minimal active and inactive. Sedentary behaviours were categorized by number of minutes spent on sedentary activities. Dietary intake was assessed by a Food Frequency Questionnaire (FFQ). Food intake was classified as healthy, unhealthy/junk and traditional food. Body composition was measured by calculating body mass index (BMI) (weight/height2) and waist-to-hip ratio, respectively. Categories: underweight: 0<18, normal weight: 18, 5<25, overweight: 25<30 or obese: 30 and blood pressure measurements were classified as healthy and unhealthy. The main findings were as follows: underweight 60, 25 percent: normal weight 30, 54 percent: overweight 4, 18 percent: and obese 5, 02 percent: for the peri-urban school learners. Underweight 64, 78 percent: normal 31, 52 percent: overweight 2,83 percent: and obesity 0,87 percent:for the rural school learners. 56,25 percent underweight: 36,93 percent normal weight: 5,68 percent overweight: and 1,14 percent obese for the urban school learners. Most of the school learners in all the three residences prefer unhealthy/junky food. Based on the results, an exploratory factor analysis was conducted on data to identify and analyse the factors for model development. The findings indicated that there is evidence of low level of physical fitness and high prevalence of excessive weight and obesity among primary school learners, the study, therefore, suggests the development of the behavioural model to enhance physical fitness and prevent or reduce overweight/obesity among school learners.

Most of the school learners in all the three residences prefer unhealthy/junky food. Based on the results, an exploratory factor analysis was conducted on data to identify and analyse the factors for model development. The findings indicated that there is evidence of low level of physical fitness and high prevalence of excessive weight and obesity among primary school learners, the study, therefore, suggests the development of the behavioural model to enhance physical fitness and prevent or reduce overweight/obesity among school learners.

However, data on the quantities of food disposed remains limited, especially for developing, countries including South Africa. Global food waste estimates suggest that households in developed countries waste more food than those in developing countries. Further, research shows that lack of food waste management impacts negatively on the global efforts to combat food waste generation. I therefore set out to present primary data relating to household food waste generation and minimisation within a South African context. The case study covers two towns in the Eastern Cape province, namely Cradock and Middelburg, with a combined population of 55 352 people. Household food waste assessment and quantification was undertaken using two methods, 1) questionnaires to explore quantities of different types of food wasted by households, and 2) kitchen scales to measure the amounts of food discarded by households. Participating households in each suburb were selected randomly. Differences in shopping and household food waste behaviour in households from different income suburbs is vital to understand as it sets an effective approach to food waste interventions that might have a positive impact in minimising food waste generation. In this thesis, differences in shopping and household food waste behaviour across households in the affluent, middle and low-income suburbs is uncovered. A questionnaire was conducted and households in the affluent suburbs purchased food more frequently and had the highest percentage of respondents that used shopping list when buying food than those in the middle and low-income suburbs. The thesis also indicates that households in the low-income suburbs were more attracted to food special offers and had a higher proportion of respondents who could not distinguish between “Use by” and “Best before” dates than those in the affluent and middle- income suburbs. The reasons to food waste generation overlap between the towns. However, between the suburbs, the respondents from households in the affluent suburbs pointed that they were mainly generating and disposing food waste because they did not think it is an issue. Excessive cooking and food expiring before being consumed were found to be the most common reasons for food waste generation and disposal among households in the low and middle-income suburbs. The times which households are likely to generate more food waste were investigated. Nonetheless, only a few households indicated that there were times that they generated and disposed more food in the bins. The most cited times in the affluent suburbs were during Christmas (54%) and in summer (41%). Festive season (65%) and traditional ceremonies (37%) were the most cited times in the middle-income suburbs, while festive season (46%) and the summer season (36%) were the most cites among households in the low- income suburbs. The dimensions of shopping and household food waste behaviour is reflected in the types and quantities of food waste generated. The results reveal that vegetables were the most wasted food type in Cradock (26%) and in Middelburg (30%), while tinned food and dairy were the least discarded food types in both study towns with no significant differences in proportions of households discarding all six food types. One of the key results is that the average self-reported and weighed food waste generated per capita per annum for the two towns was 23.40±47.20 and 202.60±128.30 kg/capita/year, respectively as compared to the estimated 6-11 kg per annum in sub-Saharan Africa and South and Southeast Asia. Between the towns, Cradock generated more food waste (5.05±2.68 kg) than those in Middleburg (3.84±2.59 kg) in the previous 48 hours. It was also evident that each household and each person in Cradock generated more food waste at breakfast and the least at lunch, while in Middelburg the highest average amount of food waste generated was observed at supper and the least at lunch. The results indicate that household size and employment status were negatively correlated to food waste generation, while wealth status and gender were positively correlated to food waste generation. Majority of households (74% in Cradock and 73% in Middelburg) had no household food waste minimisation strategies implemented. The most cited strategies in place were cooking less frequently, cooking small portions and chopping and freezing vegetables as an anti-food waste strategy. Worth noting is that the small proportion of households with strategies in place are faced with a challenge of some household members showing unwillingness to effectively implement the strategies. This study sought to investigate how social enterprises in Buffalo City Metropolitan Municipality (BCMM) contribute to sustainable social development within the municipality and the country at large. The study endeavoured to answer the following research questions: what is the knowledge level among the selected stakeholders on social enterprise in BCMM? What is the scope, application, and sustainability of selected social enterprises in BCMM? What is the contribution of selected social enterprises in social development in BCMM? What are the bottlenecks associated with the application of social entrepreneurship in BCMM? These questions were answered through mixed methods approaches and techniques, where both qualitative and quantitative data was collected and analysed. The data was collected through in-depth interviews (key informant technique) and a min-survey which was administered to users of the social enterprises. Qualitative data was analysed thematically, while quantitative data was statistically analysed with help of SPSS software. The interpretation of the findings was premised on pragmatic and transformative paradigms. The study further used theoretical lenses such as empowerment theory, capability approach and positive theory of social enterprise to support and explain the findings. The main findings showed that: the selected stakeholders conceptualized social enterprises through the African lens of communal living; the social enterprises widely provided their services across a range of sectors and geographical locations; the social enterprises had direct and indirect contribution to socio-economic development in BCMM. This was specifically through provision of employment, training and skill development among others; the future of social enterprises in the country is bright as many sectors presented opportunities for social investment; and social enterprises face financial constraints, lack of skills in the sector, and competition from the mainstream market. The recommendations from this study address government entities, social services providers and practitioners, social enterprises, and researchers on pertinent endeavours to improve the growth and development of social enterprises. The study concludes that social enterprises are: vital vehicles of socio-economic development, more especially for the marginalized segment of the populations; tools for reducing inequality; platforms for innovations, community participation and conduits of empowerment interventions. Thus, social enterprises play dynamic role and presents potential for capable sustainable social development in the local communities and the South African community at large.

- Description: This thesis intends to contribute to the discourse on global justice as it pertains to resources, the distribution of resources, and the allocation of resources. The focus is on the concept of scarcity. I examine scarcity for how it is understood, interpreted, and applied in the literature on global justice. This thesis argues that scarcity lacks conceptual clarity in the discourse on global justice and argues that if scarcity is misconstrued, the consequences can be severe. Conceptual clarity is thus necessary to ensure that scarcity is properly referred to in the discourse on global justice so that scarcity is not erroneously used when justifications are sought for material deprivation and consequent human suffering. In the process, I will also examine how scarcity is used as a justification in instances of material deprivation and why this is problematic. Given the lack of conceptual clarity regarding scarcity, I argue that reliance on scarcity as justification may be erroneous. The conflation of absolute scarcity and relative scarcity may amount to a category mistake. This thesis purports to clarify scarcity conceptually in the context of global justice. In doing so, I recommend that a resource-centric approach to resource scarcity is adopted to accurately account for the scarcity status of resources. A resource-centric approach to resource scarcity based on a more nuanced understanding of scarcity avoids the potential category mistake. - Description: [From Introduction] For the past 8 years Rhodes University has maintained a research output record (based on publications and Masters and PhD graduates) which has placed it consistently amongst the top three universities in the country on the basis of outputs per capita academic staff member. The past year was no exception. Journal publications were the highest to date (261.9 units) and Masters and PhD graduates (274 units) are amongst the highest achieved, largely due to the record number of PhD graduates (33) in the Science Faculty. In recent years this per capita output has consistently been over 60% higher than the national average. An encouraging aspect of the journal publications in 2007 is the increase in the percentage of articles in subsidy earning journals. While it is appreciated that the most appropriate journals in certain fields of research are not always those that are on the Department of Education’s approved lists, it is financially critical to the University’s research effort and the University as a whole that subsidy earning outputs are maximised. Another positive outcome of the most recent audit of Rhodes’s research outputs (2006; 2007 data will only be available at the end of 2008) is that 89% of the publications in the form of books, chapters and conference proceedings submitted to the Department of Education were approved for subsidy. This is a significantly higher percentage approval than in the past. The award of two highly prestigious NRF/DST Research Chairs to Profs Tebello Nyokong and Christopher McQuaid as part of the first round of the SA Research Chairs Initiative was another major achievement. These Chairs will significantly enhance the research profile and productivity of the University as will the recent award of the highly prestigious Centre of Excellence in Nanotechnology to be headed by Prof Nyokong. Only three such centres of excellence have been established and were officially launched by the Minister of Science and Technology in November 2007. The Centre will be host to researchers from throughout South Africa and will focus on novel technologies for cancer treatment and the development of new biosensors for disease treatment and water contamination. An encouraging statistic recently released by the National Research Foundation indicates that Rhodes has the fourth highest percentage (15.4%) of rated researchers in the country which is an excellent achievement. NRF ratings are awarded to researchers in all disciplines who are regarded as national and international leaders in their fields. Amongst these researchers, three were also recognised by the University and were awarded the Vice-Chancellor’s Research Awards (see highlights section). Postgraduate students have once again been the cornerstone of much of the research activities in all Faculties and have contributed significantly to the research outputs of the University both as co-authors on publications and through the good graduation rates of Masters and PhD candidates. This is particularly evident for example in the Science Faculty, in which Masters and Doctoral students contributed to over 90% of the Faculty and 60% of the University’s outputs. A key factor in the high profile and success of postgraduates at Rhodes is the excellent supervision they receive and all supervisors are to be congratulated for their dedicated approach to what has become an increasingly onerous academic responsibility. They and the Research Office have benefited enormously from the very able support of the Postgraduate Liaison Committee chaired for a second year by Dan Parker. The work of this committee is highly valued. Finally, this will be my last contribution to the annual Rhodes Research Reports as I will be retiring at the end of 2008. I would like to wish my successor with responsibility for Research at Rhodes, the new DVC: R&D Dr Peter Clayton, every success in the future which I am confident will see research at the University going from strength to strength. I would also like to take the opportunity to express my sincere and grateful thanks to all those who have supported me and contributed to the success of Rhodes research in my past 10 years as Dean of Research. This includes two Vice-Chancellors, members of Senior Management, Deans, Heads of Department and staff and postgraduate students in both academic departments and administrative divisions. In particular, a very big thank you to all the staff who have worked in the Research Office and have made such a significant contribution over this past decade. Special mention must be made of my first Assistant, Moira Pogrund, who was instrumental in the establishment and success of the Research Office from its inception in 1998. She gave true meaning to the word efficiency and her outstanding contribution is being continued by the excellent work of her successor, Dr Heather Davies-Coleman. John Gillam has been a tower of strength in the management and administration of postgraduate financial aid and has been an invaluable advisor and confidant to countless postgraduate students over this period.

The study formulated 6 objectives as follows: examine the nature of Conflict experienced in Public Secondary Schools in Kenya; establish how teachers and students perceive conflict in secondary schools; determine how teachers and students experience conflict in Secondary Schools; investigate the effectiveness of conflict Management Programmes used in Secondary Schools; discover suitable conflict management programmes to address present and future conflict in secondary schools; generate findings based on a theoretical approach for understanding and managing conflict in secondary schools with particular reference to schools in Kenya. The research was conducted in the form of a descriptive survey design with a mixed methods approach which combined qualitative research design and quantitative research technique. A sample of 649 Students, 16 secondary school head teachers, and 16 secondary school guidance and counseling officers from 4 provinces in Kenya was used to obtain data for the study. Random and purposive sampling techniques were used. Data was collected using questionnaires and structured interviews. Descriptive statistics such as mean, percentages, standard deviation, and frequencies was used to discuss the research findings. The study also used inferential statistics, particularly chi-square to test the significant statistical differences on the nature of conflict in schools, how students and teachers experience and perceive conflict in different categories of schools. From the findings, students witness conflict in form of theft, 51.7%, bullying, 29 percent, rumours and fights. Results from males and females indicate that drugs are abused in secondary schools (males (26.8%) and females (13.6 percent). All the respondents revealed that students take drugs to please their peers, and to release stress, and for adventure. On the effectiveness of conflict management programmes, a majority of students accept punishment when they break the school rules (80.0%) as they feel that punishments improve their behaviour. Most of the teachers had not had proper training in conflict management and some of them do not understand the role of peer mediation as they lack such programmes in their schools. The study concluded that failure to train teachers in conflict management skills, and to involve students in decision making causes conflict in schools. The study recommended that life skills, and peace keeping lessons should be taught in schools. In addition, head teachers and teachers should go for a refresher course in conflict management. Also, the study recommends that a comparative study should be done in a wider scope in secondary schools that experience conflict and those that do not, so as to get an insight of the suitable strategies needed to manage conflict in schools.

Despite being one of the missionary pioneers of Methodism in southern Africa, serving for more than forty-six years in various districts and being elected as chairman of two of these districts, very few people have ever heard of James Cameron. Barnabas Shaw says of Cameron that he "excelled in preaching the great truths of the gospel, and applying them to the heart of sinners".¹ Whiteside describes Cameron as a "remarkable man ... well read in most things".² W.B. Boyce pays Cameron an even greater tribute: In my day, as a preacher and as a theologian, he was unequalled in South Africa; and I do not think that he was second in these respects to any of his brethren in England.³ Notwithstanding the high esteem in which he was held by prominent peers, Cameron is mentioned only in passing in a few secondary sources, and to date has not been the subject of academic research. The reason for this is not clear. He was well educated, read and wrote extensively, and most of his correspondence has been preserved. Cameron's Journal is very well written, containing some beautiful poetic sections. It is a personal record of a missionary coping with peculiar and difficult circumstances, and a record of how determination, courage and faith enabled Cameron to overcome seemingly insurmountable difficulties. Cameron's recording of his struggles help fill out our understanding of missionaries and their tasks and problems in the nineteenth century. I believe that so important a figure in South African Methodism should be examined and deserves a definitive study.
