The role of civil society organizations in the consolidation of democracy : cases from Cameroon and South Africa

- Description: This study investigates the role played by civil society organizations in the consolidation of democracy. It is a comparative study between South Africa and Cameroon. This study utilizes the Habermasian critical theory of civil society which emanates from the liberal ideology of democracy. The objectives of the study were to look at the legislations regulating the operation of NGOs, the activities carried out to consolidate democracy and the challenges faced by these organizations in both South Africa and Cameroon. The qualitative method was used for data collection for the study. Interviews were carried out with NGOs officials and the data was analyzed using thematic analyses. The research found out that there is a liberal legislative framework governing the activities of NGOs in South Africa. On the other hand, though Cameroon laws on association seem liberal, a careful study of these laws revealed a concerted effort from the state to constrain the operation of NGOs. NGOs in South Africa carryout activities such as picketing, publicity stunts, human rights awareness campaigns, anti-corruption campaigns, lobbying of parliament, protests, mass mobilization and public interest litigation to consolidate democracy.In Cameroon, NGOs are involved in activities like strike actions, public protest, human rights and anti-corruption campaign as well as public interest litigation to consolidate democracy. However, South African NGOs face challenges like administrative bottlenecks, legal draws backs, sporadic hostility from the state, inadequate funding and lack of staff capacity. In Cameroon, NGOs faced the following challenges; restrictive legal framework, arbitrary arrests and detention of activists, financial constraints, lack of staff capacity, lack of infrastructure, corruption and internal divisions.

- Description: This study seeks to examine economic activity using anthropological perspective at Lower Gqumahashe. This settlement possesses natural resources that favour agricultural development. For instance, water resources include Tyhume River, which is the main source of irrigation. Tyhume Rive is the perennial river that runs along the study area. Other possible sources of irrigation are local livestock dams and the main water pipe supplying University of Fort Hare and Alice town. The study recommends that local female farmers should be encouraged to participate in adult basic education using incentives.

This study is concerned with one such: the Cofimvaba struggles of 1962-3 which was organised by Cofimvaba migrants under the ideology of the Pan Africanist Congress. Whereas previous historians have based their accounts mainly on trial records, this thesis strives to recover the migrants’ own perspective through intensive and detailed interviews with the surviving veterans. The role of the church in social development : the case of selected churches in Nairobi, Kenya

Primary to the core responsibilities of the church, according to Scripture, is to reconcile creation to the Creator by transforming society to regain its lost nature. The Christian Church in Kenya was established by missionaries from different parts of the world about three centuries ago. It has since grown and spread to almost all the parts of the country, but all the major denominations have vibrant congregations in Nairobi. A quick categorisation of the church in Kenya would be into the Mainline and the Pentecostal churches. This study set out to investigate the perception the church in Nairobi holds on in its involvement in social action, whether the church thinks social action is part of its ministry, and what kind of engagements in social action the church in Nairobi is currently having. The study employed a qualitative approach and an exploratory design. Using the questionnaire and interview methods, data was collected from thirty two (32) church leaders (including pastors) sampled to be representative of the Mainline and the Pentecostal groups of churches. The data was transcribed, coded, categorised and interpreted following the themes which emerged in relation to the study objectives and the nature of the responses. The results of the study show that the church holds different perceptions on its responsibility and involvement with regard to social action. The findings show two extremes: those who see social action as core to the mission of the church and those who think social action is the responsibility of the government or of non-governmental agencies. Generally most churches do not plan or budget for social actions. The few that are engaged in in it the budgets are far too low compared to the other church activities and the plans are unstructured and sporadic Active engagement in social action by the church in Nairobi is therefore, by and large, unplanned and episodic. However, the few who are already engaged in social action have witnessed great success in community transformation. The study concludes that the church has not fully understood its ministry and this could be the reason why social action is not part of its agenda. This further explains the sporadic and truncated nature of social action in the church in Nairobi. The study recommends a review of the curriculum in seminaries and the retraining of practising pastors to embrace holistic ministry. This will address the current misconceptions, address the current dichotomy of sacred-secular in church ministry, and hence increase organised participation of the church in social action.

The role of the school management team in ensuring quality education: a case study of the iQonce high school in the Buffalo City Metro Education District in Eastern Cape

Within education, the change has seen the significant transformation of the education system. One of the primary aims for the transformation of the education system was to provide quality education to all the children of the Republic of South Africa. The School Management Teams (SMTs) were introduced in order to increase accountability within a transformed education system. The aim of the study was to investigate the role of SMTs in ensuring quality education, with the aim of finding sustainable ways of improving the quality of education at the Iqonce high school at the Iqonce high school and the department of Education in the Eastern Cape Province. The objectives of the study were: a) To assess the role played by SMT in enhancing quality education at Iqonce high school in King Williams Town. b) To assess the role played by SMTs in enhancing quality education. c) To assess the challenges faced by the SMT in managing quality education and the functionality of the school. d) To identify training needs for SMTs to operate in their full capacity educational leadership and management. e) To explore an alternative policy framework that will help the SMTs in enhancing quality education. A qualitative research approach was employed and included an interview guide. Participants included four (4) SMT members, six (6) educators and six (6) parents drawn from the SGB of the Iqonce high school in the Buffalo City Metro Education District. Research findings indicated that the Eastern Cape Department of Education (ECDoE) does not fully support the SMT members at Iqonce high school in their role of ensuring quality education. The study made numerous recommendations which included training of SMT members on how to manage the school. The ECDoE must work very closely with SMT members at Iqonce high school, also listens to their concerns. The teachers must understand that in order for SMTs to work effectively they need their support, even other stakeholders must support SMTs. There needs to be sound annual plans with targets that show how the annual target will be achieved.

The role of ward committees in the local government sector: a case study of Enoch Mgijima local municipality of Eastern Cape (2012 – 2016)

A ward committee system was introduced in South Africa, as a channel for driving public participation programmes. This study set out to examine the experiences of ward committee members in Enoch Mgijima Local Municipality (EMLM). The aim was to assess the ward committee system as a vehicle for meaningful public participation in the integrated development planning processes. In 1995 the government formulated the White Paper on the Transformation of the Public Service. It indicated the importance of service delivery, and the aim was to transform the South African public service, as the key machinery of the government to equalize service delivery to all citizens. In 1996, the Constitution of the Republic of South Africa anchored the Bill of Rights as the cornerstone of democracy that enshrines the rights of all people and affirms the democratic values of human dignity, equality and freedom. The South African government has developed a wide array of legislation that ensures that communities are consulted on an unremitting basis with regard to how services need to be rendered. Communities have a right to be consulted and to give input into issues affecting them. Public consultation as envisaged in the South African legislation has, nevertheless, not yielded the desired results, which is evident in the spate of service delivery protests over poor or non-service delivery. Section 152(1) (e) of the Constitution promotes involvement of communities and community organisations in the matters of local government. Section 73 of the Municipal Structures Act (Act 117 of 1998) also requires municipalities to establish ward committees in a manner that seeks to enhance participatory democracy at the local level. This study set out to explore the experiences of ward committee members in EMLM. The scope of environmental protection under the legal framework of the World Trade Organisation : an evaluation of the issues and implications for developing countries

- Description: Over the years, the extent to which the legal framework of the World Trade Organisation (WTO) makes provision for environmental protection has been a major issue within the organisation. While trade liberalisation and environmental protection are fundamental objectives of the WTO to be pursued in line with the sustainable development goals as enshrined in the Preamble of the Marrakesh Agreement, the organisation does not have a specific agreement on the environment. Moreover, efforts by the member states of the WTO to reform the environmental protection regime of the global trading system have achieved little. Nevertheless, under the current legal framework of the WTO, members are allowed, subject to a number of conditions, to adopt trade-related measures aimed at protecting the environment. Employing documentary research methodology, this study critically evaluates the relationship between trade and the environment, the provisions made for environmental protection in selected WTO agreements and the extent to which trade-related environmental protection measures are permissible under the legal framework of the WTO. It also evaluates the implications of unilateral and the Multilateral Environmental Agreements (MEA)-based environmental trade measures as well as the possibility of a clash of policy objectives between the WTO Agreements and the MEAs, given that some of the MEAs contain environmental trade measures prohibited by the WTO free trade rules. The findings made in this study suggest that states generally prefer to enforce unilateral environmental trade measures against foreign goods. This has allowed states, in some instances, to hide under the guise of environmental protection to pursue protectionist’s interests, eco-imperialism, etc., leading to the trade and environment-related disputes at the WTO. Moreover, the WTO is made up of member states that are at different levels of development and possess different environmental protection standards. Hence, there is concern from developing countries, on the one hand, that their economic interests are being frustrated by the stringent application of unilateral environmental trade measures in the developed countries, and, on the other hand, that the environmental burden of international trade is being shifted to the developing countries as the developed countries tighten their environmental standards. The study concludes that the environmental protection regime of the WTO as it stands is not adequate to guarantee the balance of trade and environmental protection objectives as well as the balance of interests between the developed and developing countries. The study, therefore, recommends reform in the environmental protection regime of the WTO to ensure that the environmental protection measures are adequately provided for and that balance of interests between the developed and developing countries is maintained in order to ensure sustainable global trade. It further recommends that a mutually reinforcing relationship should be established between the WTO and the MEAs to avoid a possible clash of policy objectives.

The study, therefore, recommends reform in the environmental protection regime of the WTO to ensure that the environmental protection measures are adequately provided for and that balance of interests between the developed and developing countries is maintained in order to ensure sustainable global trade. It further recommends that a mutually reinforcing relationship should be established between the WTO and the MEAs to avoid a possible clash of policy objectives.

Failure to provide a speedy resolution of disputes, large number of referrals to the Commissioner for Conciliation, Mediation and Arbitration (CCMA) and a large number of review applications lodged at the Labour Courts are some of the contributory factors that delay matters in bringing to finality. It is therefore the aim of this study, to proffer plausible recommendations that intends to cure and provide a silver bullet to the lacuna which exists in the current labour dispute system. To achieve the above stipulated aim, a general background of the study, accompanied by the chronicles of dispute resolution statutes and mechanisms is deliberated. Thereafter, South African compliance with International Labour Organisation (ILO) Conventions is discussed to assess the efficacy of labour dispute mechanisms. The study further reveals that there is usage of electronic information resources; however, there are library users who prefers to use search engines such as google, yahoo etc. It was also identified that there are two important barriers that hinder the use of electronic information resources, i.e. physical and personal barriers. The study recommends that University of Fort Hare library should consider including e resources in the collection development policy. It is also recommended that the library online training/tutorials must be installed on the library website to increase the usage of e-resources. In order to stay relevant and visible, librarians should embrace new opportunities and go beyond the comfort zone of traditional librarian principles.

A purposive sample of forty (40) respondents was selected from the library staff from both the University of South Africa and University of Fort Harelibraries. The collected data were analysed using the Statistical Package for Social Sciences 23 (SPSS 23) and Microsoft Excel 2010. The findings of the study revealed reasons for both academic libraries to invest in RFID technology; these reasons include RFID’s ability to deliver self-service options, inventory control, improved reader access and improved security. The challenges related to the implementation of RFID technology are also related to staff not being rewarded by library management for being innovative; the difficulty of staff learning new technology; the staff’s inability to generate new ideas for the library; and the staff not being able to share knowledge with each other. Further research needs to be conducted by library RFID vendors in order to meet the need, of academic libraries, for RFID inventory control. RFID hardware and software (API software) should be subjected to further investigation for the purposes of research and development. Libraries should work closer with RFID vendors so as to trial and test hardware and software.

The findings of the study demonstrated that the participants selected textbooks from the ones prescribed by the department that were written in the CAPS documents. They had no influence or decision on textbook selection. All the teachers believed that lesson plan is very important and it is a must to have a very detailed and comprehensive lesson plan that is well-aligned to the contents of CAPS document and the textbook. The study further revealed that, for effective delivery of lesson and planning, there is need for a practical use of textbooks by the teacher. The study concluded that one of the most fundamental issues to consider is the fact that, as good as the use of textbook for planning and delivery of lesson activities is, it can also be a problem if not carefully and professionally planned and used accordingly. The over-dependence on textbooks at the expense of other resources may cause ineffective learning and teaching of mathematics.

It also evaluates the extent to which selected social entrepreneurship interventions have contributed to employment creation and income generation. Furthermore, not only does the study investigate social entrepreneurship opportunities available for rural youth in Amathole but goes further to evaluate the sustainability of existing social entrepreneurship projects. The challenges faced by rural youth in pursuing social entrepreneurship are also explored. In so doing, the study is underpinned by the Positivist Youth Development (PYD) theory. The study found that the youth of Amathole District Municipality have a positive attitude towards social entrepreneurship. They engage in a variety of social enterprises. However, the youth face many constraints such as lack of access to finance, lack of business skills, lack of entrepreneurial education and lack of technical support. All these constraints are interrelated and lead to issues of unsustainability and limited income generation and employment creation. Informed by these constraints, the study recommends coordinated awareness campaigns and government (national/provincial) response about social entrepreneurship and community needs within Amathole. To further understand social entrepreneurship, there is need for further studies to investigate the attitudes and constraints of women towards social entrepreneurship as well as youth’s understanding of social entrepreneurship in general.

This study assessed the effect of elements of Guided Inquiry Learning (GIL) on enhancing academic performance of first year students in Introduction to Computer Programming course. As learners from schools join the university and enrol for different courses, they find the sudden transformation quite challenging. This makes it more challenging for first year university students, especially in difficult courses such as Introduction to Programming. As times change with advances in technology, the traditional ways of presenting information during teaching–learning interface may not address students’ needs. Lecturers and university stakeholders make efforts to address these challenges by proposing innovative teaching ways. One of the common approaches that have been used profitably in other science and engineering programmes is GIL. It is a form of inductive collaborative learning approach where students are presented with a challenge which challenges them to accomplish the desired learning outcomes in the process of responding to the posed challenge. The strategies in GIL include, among others, learning teams who participate in intra- and inter-learner interactions besides lecturer-learner interactions, linking theory and practical information cementing skills and problem solving strategies, scaffolding information, blended learning by integrating both traditional and technology-assisted learning, inquiry activities such as initiating investigations, gathering data, and critiquing evidence to come up with evidence-based solutions. The objective was to apply GIL to this module and observe if there were gains in students’ academic performance. This study was located in the pragmatic paradigm using action research design and a mixed method approach. The sample consisted offirst year students enrolled for Introduction to programming which was a year-long course (two semesters) at a South African university. The population consisted of the only 49 students who were registered for the module under focus. A group of 20 students were considered for the whole year in the GIL experiment. Although it would have been ideal to have experimental and control groups with same number of students, that was not possible in this study, because only 20 out of the 49 who were willing to be included in the experimental group. The present researcher employed willing to be included in the experimental group. The present researcher employed three of these GIL strategies in teaching the module Introduction to Programming to the experimental group while another colleague continued with traditional teaching in the control group. Care was taken to limit the insider outsider conflict. Both groups were assessed by the same assessment tools at the same times. Results from these assessments together with focus group interviews provided the core data for this study. Both quantitative and qualitative analyses were carried out on the data, statistical analysis (mainly, chi-Square and t-test) for the former and thematic analysis for the latter. Results indicated gains in the experimental group such as enhanced motivation, interaction, intra-group social cohesion, creativity and provided students the confidence to share knowledge and skills with their peers and keep everyone focused on the course contents. These gains are reflected in higher year marks and pass rates than those in the control group as the analysed data indicate. A study that will pilot the GIL framework in several universities with different teaching modes and large classes are recommended.

It is a form of inductive collaborative learning approach where students are presented with a challenge which challenges them to accomplish the desired learning outcomes in the process of responding to the posed challenge. The strategies in GIL include, among others, learning teams who participate in intra- and inter-learner interactions besides lecturer-learner interactions, linking theory and practical information cementing skills and problem solving strategies, scaffolding information, blended learning by integrating both traditional and technology-assisted learning, inquiry activities such as initiating investigations, gathering data, and critiquing evidence to come up with evidence-based solutions. The objective was to apply GIL to this module and observe if there were gains in students’ academic performance. This study was located in the pragmatic paradigm using action research design and a mixed method approach. The sample consisted offirst year students enrolled for Introduction to programming which was a year-long course (two semesters) at a South African university. The population consisted of the only 49 students who were registered for the module under focus. A group of 20 students were considered for the whole year in the GIL experiment. Although it would have been ideal to have experimental and control groups with same number of students, that was not possible in this study, because only 20 out of the 49 who were willing to be included in the experimental group. The present researcher employed three of these GIL strategies in teaching the module Introduction to Programming to the experimental group while another colleague continued with traditional teaching in the control group. Care was taken to limit the insider outsider conflict. Both groups were assessed by the same assessment tools at the same times. Results from these assessments together with focus group interviews provided the core data for this study. Both quantitative and qualitative analyses were carried out on the data, statistical analysis (mainly, chi-Square and t-test) for the former and thematic analysis for the latter. Results indicated gains in the experimental group such as enhanced motivation, interaction, intra-group social cohesion, creativity and provided students the confidence to share knowledge and skills with their peers and keep everyone focused on the course contents. These gains are reflected in higher year marks and pass rates than those in the control group as the analysed data indicate. A study that will pilot the GIL framework in several universities with different teaching modes and large classes are recommended.

This, however, needs to be adapted to the South African context with specific indicators being selected by local stakeholders that will promote best possible patient outcomes and a positive experience of patient-centred care at effective and efficient public health facilities. Lessons can be drawn from other countries’ experiences that have implemented hospital performance assessments and tested specific performance indicators.

In addressing the opacities of form engendered by “Work on demand via app” and the “Uberisation of work”, the study also attends to the significant and neglected component of labour law’s traditional dilemma. Put simply, how the law identifies an “employer” as a counterparty with an “employee”. Certain features of modern business organisation such as vertical disintegration of production, and their link to the rise of precarious employment underscore the extent to which the concept of employer plays a central role in defining the contours of labour protection. The problems of precarity are deep-seated, long-term and even escalating, especially in compelled and dependent self-employment. Re-appraisal South Africa’s black box of precarious self-employment through the lens of Canadian dependent contractor jurisprudence points to key limitations that should be addressed for a more robust and effective vision of labour regulation. If the definition of “employee” in section 213 of the Labour Relations Act 66 of 1995 is amended to redefine an “employee” to include a “dependent contractor”, this will represent a leap forward in tackling the interlinked problems of disguised employment and precarious self-employment. This statutory redefinition of the employee serves two purposes. First, the dependent contractor category solves the broader challenge for labour regulation of how to extend protection to persons who have some of the trappings of the independent contractor, but, in reality, are in a position of i ii economic dependence, resembling that of an employee. In essence, the intermediate category recognises that, as a matter of fairness persons in economic positions that are closely analogous should be given the same legislative treatment. The second purpose, and one no less important, is to fill in the missing piece of the puzzle in the judicially endorsed three-tiered SITA test for identifying employment relationship. If the dependent contractor category is adopted, the lacuna in the threefold SITA test that has so far escaped scholarly, judicial and legislative will be resolved. In this regard, the study contributes to a line of legal scholarship that has tracked the regulatory trajectory for reforming South Africa’s labour laws. It is hoped that this thesis will provoke a sustained, and more curious engagement with the complexities and capacities of labour regulation

Transformative potential of social protection in fragile contexts : a case study of the social cash transfer pilot scheme on child wellbeing in Bomi County of Liberia

In the context of fragile states, questions of misuse, inaccessibility of social services, dependency and sustainability are often raised. This study sought to examine the transformative potential of social cash transfers on child wellbeing in fragile contexts through a case study of the social cash transfer pilot scheme in Bomi County of Liberia. The study specifically set out to to assess the relevance of cash transfers in the context of child wellbeing; determine how the wellbeing of child recipients of cash transfers had transformed; and analyse the determinants of the transformative effects of cash transfers on child wellbeing. The study adopted a quasi-experimental, mixed method, and cross-sectional research design. It utilised existing household survey datasets of the mid term and end term evaluations of the Bomi County pilot social cash transfer scheme conducted in Liberia in 2012 and 2015 respectively. A sample size of 224 (about 12percent of the sample frame) was used where Confidence Level was 95percent and P=0.5. This sample size was divided equally between households receiving cash (experimental group) and households with the same characteristics although not receiving cash transfers (control group). For the qualitative method, 66 participants were purposively sampled. A total of 34 participants participated in the indepth interviews, 32 children were sampled for focus group discussions. These were divided into 16 children from the experimental group and 16 children from the control group. Quantitative data sets were analysed in Statistical Package for Social Sciences (SPSS), and qualitative data was analysed through thematic analysis. The findings from the study provide a persuasive case for the transformative potential of social protection in fragile contexts. The study confirms the relevance of social cash transfers in promoting child wellbeing through empowering families to address children‘s physical and dependency-related vulnerabilities and institutional disadvantage. The study also confirms the transformative effects of social cash transfers on child health, food consumption, education, housing conditions, household assets, and child labour. In addition, the results indicate that social cash transfers mitigated gender based institutionalised disadvantage, created safe and protective environments for children and positively impacted on the local economy. However, the study also showed that, to a limited extent, social cash transfers had unintended impacts, particularly increase in child labour, where children were requested to sell in family petty businesses, and instances in which recipients misused the cash. The transformative effects of social cash transfers on child wellbeing were dependent on the size of the transfer, priorities in the use of cash, decision-making dynamics, and fairness of the selection process. The study proffers a Child Sensitive Transformative Social Cash Transfer Model based on the determinants of the impact of social cash transfer. The study ends by highlighting the critical role of social protection in infusing a transformative dimension to social work practice in fragile contexts, with a view to addressing equity, gender equality and child rights through confronting child vulnerabilities and institutionalised disadvantage.

- Description: This thesis sought to critically examine the origins, nature and impact of ZANU PF factionalist tendencies and how a particular faction headed by former Vice President Emmerson Dambudzo Mnangagwa was represented in Zimbabwean public discourses. Drawing from comparative politics, history, media studies and Zimbabwean current affairs, this interdisciplinary narrative detailed how the new media played a central role in precipitating factional implosion in the liberation war based political party (ZANU PF). Clearly, ZANU PF internecine conflicts in and outside the state controlled and new media had far-reaching socio-economic and political ramifications as rival ZANU PF factions resorted to dirty strategies and tactics to try and weaken and outwit each other. These political machinations took the form of slandering, use of hate speech, dissemination of fake news, assassinations and poisoning among others. As the battle for factional supremacy raged on, the Zimbabwean economy continued on a downward spiral due to inter alia policy contradictions and uncertainty but at the end, November 2017 saw Mugabe being unexpectedly deposed in a coup after 37 years in power. This study went on to identify a number of factors that were working against Mugabe’s patient and heir apparent – Mnangagwa, as he sought to take over the reins of power. These included inter alia the presence and close proximity of the G40 faction linked to the first family but opposing the former vice president, his tainted political record as a result of his involvement in the Matabeleland massacre of the Ndebele ethnic group in the 1980s, allegedly masterminding and engineering electoral fraud in 2008 and having been Mugabe's right hand man for almost four decades. On the other hand, findings from this study suggest that Mnangagwa’s liberation war credentials and his close association with the military and the war veterans played a pivotal role in assisting him to land the presidency following Mugabe’s forced resignation or what was defined by many as a coup. While the Lacoste faction eventually prevailed over their G40 rivals, the study concluded that ZANU PF factionalism negatively impacted on governmental decisions, policies and systems and the aftermath of the military coup continues to pose serious challenges to Zimbabwe’s political future however defined.

It is the contention of this study that places and spaces can develop more rapidly if there exists factors that support innovation and clustering. In this case, HEIs in cities are described as catalysts for growth and development within cities. By their presence in cities and their contribution through knowledge creation, production, dissemination and sharing, they become anchors of development in post-industrial cities that no longer depend on heavy industries but are driven by knowledge, hence, the knowledge economy. There are several city development theories, those that advocate for the use of big projects; others for infrastructure development; and some, for industrialization as a way to revitalize and drive city economic growth and development. This study argues that these development strategies have previously been used in the East London case but with very little success. It seeks therefore to propose that in addition to these, an anchor strategy, whereby institutions such as universities and hospitals, can be used by cities for their growth and development.
