- Description: Constitutionalism and separation of powers is the most dynamic topic worldwide. Montesquieu, the French philosopher is credited with the doctrine of separation of powers. Various countries adopted the doctrine and modified it, in order to fit their systems of governments. The reason behind is that there is no universally recognized model of separation of powers or one size fit all. Countries apply this doctrine differently in a fashion that fits their domestic laws and constitutional requirements. Montesquieu gave a classic exposition and the rationale for separation of powers in one of his well-celebrated work “The Spirit of Laws”. The concept of separation of powers emerged premised on the theory that the arms of state namely, the judiciary, the legislature and the executive, should operate within their providence without one interfering with the other. From the South African perspective, the Constitution of South Africa of 1996 requires separation of powers even though it is not explicitly so stated in the text. This research examines the unique South African model of separation of powers and how the courts have navigated through it from the time the Constitution was promulgated. It seeks to establish whether or not a South African model of separation of powers has come to the fore. The research further examines the problem of interference amongst the arms of state and mechanism of checks and balances which can be applied to prevent or minimise such interference. In doing so, the study pursued a desktop survey of primary and secondary materials, including scientific literature, legislation, courts’ jurisprudence, and official documents. A comparative perspective was also made in order to learn from the experiences of other jurisdictions where the doctrine is applied. The findings reveal that South Africa has a unique model of separation of powers. The model was learned and enriched from various foreign jurisdictions. The courts have contributed enormously to this model, which contrive to be fluid and living.

The researcher achieved the aim of this study by asking the following questions: • What are the motives of individuals/communities who take the law into their own hands? • What impact do vigilante incidents have on communities? • Which effective preventative measures can be utilized to combat vigilantism? To answer these questions, questionnaires for data collection were utilized. The study was conducted using a total population of one hundred (100) participants who were divided by two. Each community had a sample of fifty (50) participants. The participants were selected by utilizing purposive sampling technique which is non-probability sampling. The participants were the community members of the selected communities. The researcher applied a qualitative research methodology in order to obtain in-depth information and utilized content thematic analysis and SPSS software for the analysis of the data gathered. Two theories a) Differential Association Theory and b) Social Learning Theory were employed to interpret the findings of the study. iv The results of the study demonstrate that there has been an escalation in vigilante activities in Port Elizabeth communities since 2000 and 2010. In many vigilante actions that occurred, males (ages between 18 and 30 years) were found to be the majority of the people who were more likely to be victims of vigilantism because of the crimes they commit. The results also demonstrate that an increase in vigilante incidents in New Brighton and Kwazakhele have been reported to be a result of the ineffectiveness of visible policing, easy bail conditions and frustration and anger of the community members, who do not see the criminals being arrested. These vigilante activities have been reported to have negative impact in these communities specifically on children. Based on this issue of vigilantism, several strategies that could assist to combat vigilante actions were made. The participants suggested that government should improve the criminal justice system as a whole in order to reduce vigilantism. The respondents also indicated that government should create jobs for the youths because other people become involved in criminal activities, because of poverty and lack of employment opportunities. Furthermore, the participants proposed that government should enact tough laws on offenders. v.

A hermeneutic exploration of men's narratives of manhood

- Description: Manhood is a construction which must be ‘achieved’ by men and boys (Gilmore, 1990). A male child must learn to perform these constructions early in life, and then sustain this performance throughout life (Gilmore, 1990; Hurley, 2004). Booth (2012) argues that manhood is a subjective concept particular to each man’s unique set of identifications. This includes the influences of various contexts upon these life performances. Within South African historical and cultural contexts, the impact of apartheid upon manhood has to be acknowledged (Vandello, Bosson, Burnaford & Weaver, 2010; Morrell, 2001 & 2005). This study qualitatively takes a look into what manhood is perceived to mean, within various social contexts. A hermeneutic methodology is utilised within a poststructuralist framework to unpack the meaning and unique identifications of each participant interview. The data findings emphasise that there are multiple modes of manhood, which are enacted by different men as well as by the same men within different situations. Gender identity is therefore significantly flexible in principle although it is formed into specific categories under certain historical and cultural conditions (Barker, 2012). Manhood in South Africa can therefore be understood to be influenced by different historical and cultural elements. South African men may live within a conflictual space between historical and cultural discourses of manhood as well as western discourses of manhood.

A pastoral theological response to post-traumatic experiences of family members of murdered victims : a case study of Mbizana Local Municipality in the Eastern Cape

- Description: The researcher wish to shed light on the health of the victims’ family members, who had in common, the traumatic experience of having one or more of their family members brutally murdered by a serial killers, and that they numbered fourteen people, who were residents in Wards 23 and 24. Nine of the fourteen victims were females and five were males, young and old. Some victims worked at Mzamba Wild Coast Cassino Hotel, one of those workers originally came from Kwa Zulu Natal at Umzimkhulu local municipality. Serial killers either attacked the victims in their homes, whilst they were fast asleep, many of the atrocities were witnessed by their children, or they were attacked in an open field when they were dropped-off from their place of work at midnight. The serial killers, used tools like hammers, to knock victims on the heads, thereby rendering them unconscious; bush knives were then used for the removal of certain body parts. Most victims were residents of Ward 24 which is nearer Mzamba Wild Coast Cassino Hotel. Many of the victims’ bodies showed evidence of head injuries, mutilation of body parts or ‘genital mutilation’, it is alleged that private parts were used for muti purposes. There was evidence that females had been raped. Post trauma was an experience that left many in the villages of Mbizana marked by fear and anxiety. When a serial murder occurred it demanded the attention of all South Africans for several reasons, especially because it dramatically threatens and profoundly challenges our sense of safety, in particular our sense of personal safety. The serial killing as a phenomenon, challenges the larger society throughout the country, it is an emotive subject. The study is concern with prolonged soul suffering without healing, a pastoral counselling services was rendered to victims’ family members with recommendation of reconciliation and forgiveness as therapeutic measures. The study concludes by calling upon the Church as congregation to include to her programmes the topic of serial killing. The study makes recommendations to the Church to empower, make awareness, teach, and offer counselling to the congregation, that denominations must approach theological institutions for an introduction of modules that cover the concept of serial killing.

A preliminary study on the effects of elevated CO2 on aphid resistance of Tugela Dn and the population dynamics of the Russian wheat aphid (Homoptera: Aphididae), Diuraphis noxia

Diuraphis noxia (RWA), have caused aggravating, massive losses to wheat farmers in many areas of the world. If unchecked, RWA are able to destroy plants resulting in major economic impacts (Botha, 2013). Due to ineffective use of other control methods, the Small Grains Institute in Bethlehem, South Africa, have therefore developed resistant cultivars to the known RWA subtypes over the past decades through intensive breeding programmes (Tolmay et al., 2006). Climate change has however become a major factor threatening food security especially with the observed increase in CO2 from less than 300 ppm in pre-industrial period to the current 385 ppm and is predicted to reach 550 ppm by 2050 (IPCC, 2007; Meehl et al., 2007). Elevated CO2 concentration may affect individual species of a community hence the need to understand the wheat-aphid interactions. In this study, population growth rates and virulence of RWA SA1 at ambient (385 ppm) and elevated (450 ppm) CO2 concentration were evaluated on two wheat cultivars: Tugela Dn (resistant) and Scheepers (susceptible). Fluorescence microscopy techniques using aniline blue were used to investigate feeding related damage caused by RWA SA1 through an examination of callose deposition at the two CO2 concentration. A two-dimensional gel electrophoresis method was developed in order to determine the effect of RWA SA1 on the wheat cultivars proteome at the two CO2 concentration. Differentially expressed proteins that were up or down regulated more than two fold were identified using PDQuestTM Basic 2D Gel analysis software. Populations of RWA SA1 increased significantly on the two wheat cultivars at both CO2 concentration. Although the population growth rate for RWA SA1 on both cultivars was generally exponential at all treatments, growth at elevated CO2 concentration was noticeably faster with populations increasing 3 fold in 14 days as compared to the 2 times at ambient CO2 concentration. Hence, both cultivars provided a better quality host for RWA SA1 at 450 ppm than 385 ppm. There was no significant difference between RWA SA1 population on Tugela Dn and on Scheepers at elevated CO2 concentration on day 14 after infestation which means there was a change in the resistance mechanism in Tugela Dn at this condition. Approximately 70% of the total leaf showed chlorosis by 21 days of aphid infestation for both cultivars although the susceptible cultivar was more vulnerable. There was low callose deposition in the controls (uninfested plants) but heavy callose in infested plants due to aphid feeding. A proteomics approach was used as a pilot study to investigate whether it would be possible to identify the changes in the resistance mechanism during aphid infestation under elevated CO2 levels. The major changes in the proteome of the control group (uninfested Tugela Dn at ambient versus elevated CO2 concentration) occurred in the early events (day 1-7) in the molecular weight range of approximately 25 kDa to 55 kDa are mainly within the basic to neutral pH range. This was suggested to be a result of mechanisms to adjust to the CO2 concentration. Elevated CO2 results in instant higher photosynthetic rates and C:N ratios as well as changes in expression levels of SA-dependant defense genes (Lindroth 1995; Hughes and Bazzaz, 2001; Sun et al., 2013). Because most of these changes are directly regulated by proteins, it is expected that the most differential protein expression will occur immediately after the atmospheric changes (early events) as was shown in the study. Infested plants under elevated and ambient conditions showed that the stress conditions gave rise to differentially regulated proteins within the wheat proteome. Most changes occurred elevated CO2 levels. It can be suggested that the changes were a result of differentially regulated plant defence proteins which fall in this range (25 kDa - 80 kDa) such as peroxidases, chitinases and β-1.3-glucanases as well as protein kinases, heat-shock proteins and photosynthetic proteins. These results indicate that there has been changes in the resistance due to elevated CO2 because of the evident changes in the proteome. If so, then the results will be similar to those documented by Louw (2007) where up-regulation was due to putative storage proteins, proteins involved in photosynthesis, heat shock proteins and defense proteins. Of course, the pI value and molecular mass of the proteins and the identification of the proteins in these spots, must be determined in future work to specifically identify whether these suggestions are authentic. However, Louw (2007) also reports that the susceptible Betta wheat cultivar, displayed a defence response similar to the HR although it was unable to up-regulate specific defensive proteins against RWA infestation but proteins for broad resistance. Although the changes in the proteins in infested Tugela Dn under elevated CO2 concentration were not accurately identified, the defense mechanism is similar to that portrayed by the susceptible Betta wheat cultivar which shows that the resistance mechanism had been overcome. Because this was a pilot study and preliminary results were obtained due to limited funding and time constraints, suggestions were made on how to further develop the method to obtain statistically significant results.

Fluorescence microscopy techniques using aniline blue were used to investigate feeding related damage caused by RWA SA1 through an examination of callose deposition at the two CO2 concentration. A two-dimensional gel electrophoresis method was developed in order to determine the effect of RWA SA1 on the wheat cultivars proteome at the two CO2 concentration. Differentially expressed proteins that were up or down regulated more than two fold were identified using PDQuestTM Basic 2D Gel analysis software. Populations of RWA SA1 increased significantly on the two wheat cultivars at both CO2 concentration. Although the population growth rate for RWA SA1 on both cultivars was generally exponential at all treatments, growth at elevated CO2 concentration was noticeably faster with populations increasing 3 fold in 14 days as compared to the 2 times at ambient CO2 concentration. Hence, both cultivars provided a better quality host for RWA SA1 at 450 ppm than 385 ppm. There was no significant difference between RWA SA1 population on Tugela Dn and on Scheepers at elevated CO2 concentration on day 14 after infestation which means there was a change in the resistance mechanism in Tugela Dn at this condition. Approximately 70% of the total leaf showed chlorosis by 21 days of aphid infestation for both cultivars although the susceptible cultivar was more vulnerable. There was low callose deposition in the controls (uninfested plants) but heavy callose in infested plants due to aphid feeding. A proteomics approach was used as a pilot study to investigate whether it would be possible to identify the changes in the resistance mechanism during aphid infestation under elevated CO2 levels. The major changes in the proteome of the control group (uninfested Tugela Dn at ambient versus elevated CO2 concentration) occurred in the early events (day 1-7) in the molecular weight range of approximately 25 kDa to 55 kDa are mainly within the basic to neutral pH range. This was suggested to be a result of mechanisms to adjust to the CO2 concentration. Elevated CO2 results in instant higher photosynthetic rates and C:N ratios as well as changes in expression levels of SA-dependant defense genes (Lindroth 1995; Hughes and Bazzaz, 2001; Sun et al., 2013). Because most of these changes are directly regulated by proteins, it is expected that the most differential protein expression will occur immediately after the atmospheric changes (early events) as was shown in the study. Infested plants under elevated and ambient conditions showed that the stress conditions gave rise to differentially regulated proteins within the wheat proteome. Most changes occurred elevated CO2 levels. It can be suggested that the changes were a result of differentially regulated plant defence proteins which fall in this range (25 kDa - 80 kDa) such as peroxidases, chitinases and β-1.3-glucanases as well as protein kinases, heat-shock proteins and photosynthetic proteins. These results indicate that there has been changes in the resistance due to elevated CO2 because of the evident changes in the proteome. If so, then the results will be similar to those documented by Louw (2007) where up-regulation was due to putative storage proteins, proteins involved in photosynthesis, heat shock proteins and defense proteins. Of course, the pI value and molecular mass of the proteins and the identification of the proteins in these spots, must be determined in future work to specifically identify whether these suggestions are authentic. However, Louw (2007) also reports that the susceptible Betta wheat cultivar, displayed a defence response similar to the HR although it was unable to up-regulate specific defensive proteins against RWA infestation but proteins for broad resistance. Although the changes in the proteins in infested Tugela Dn under elevated CO2 concentration were not accurately identified, the defense mechanism is similar to that portrayed by the susceptible Betta wheat cultivar which shows that the resistance mechanism had been overcome. Because this was a pilot study and preliminary results were obtained due to limited funding and time constraints, suggestions were made on how to further develop the method to obtain statistically significant results.

The internal exercise of the right to self-determination entails human rights protection, participation in the political affairs of the state and autonomy arrangements. This general understanding is however problematic where a state systemically violates the rights of its people and denies them political participation in the affairs of the state. The people of South Sudan found themselves in such a situation from the time when Sudan gained independence from British colonial rule. Despite a number of negotiations with the government of Sudan, the people of South Sudan continued to be marginalised and their rights violated with impunity. They then demanded to exercise their right to self-determination externally and eventually they seceded from Sudan through the framework created by the Comprehensive Peace Agreement of 2005. In the light of the secession of South Sudan from Sudan this study proposes a remedial self-determination approach to the understanding of post-colonial self-determination. In terms of this approach when people are denied the right to exercise their right to self-determination internally, or their rights are deliberately and systemically violated, they may exercise their right to self-determination externally and secede.

In realizing these goals, the entire research process was guided by the research objectives and questions which sought to evaluate policies and strategies relevant to HIV prevalence in pregnant women. The secondary research objectives were accomplished through the review and analysis of the relevant literature and theories. Qualitative research approach was used in determining the findings and conclusions from the study. Data was collected using qualitative research methods and in this case a structured questionnaire was developed and distributed to the study participants. The Questionnaires were handed and discussed with each participant. Demographics, socioeconomic and cultural factors were considered in designing the data collection tool. These factors are known to have an impact on the prevalence of HIV. It has been shown through the study that demographic variables have an effect on HIV prevalence. Hence when considering policy interventions these should be taken into account. All the respondents were given enough time and they provided clear and comprehensive responses to the questionnaire and follow up discussions. The evaluation of the responses showed that various HIV prevention related policies are being implemented within the Lukhanji sub-district. Numerous programmes relating to HIV and AIDS, also specifically covering pregnant women are being rolled out across the sub-district. HIV prevalence in the study population is rated as average to low when comparing with the district, provincial and national statistics. Current data obtained from the study indicates that HIV prevalence stands at 17%. This finding demonstrates the heterogeneity of HIV prevalence when comparing this result with current provincial and national statistics. Evaluation of the different HIV and AIDS programmes that are aligned to provincial and national policy somehow explain the positive outcomes observed in the Lukhanji sub-district The study recommends that more work be done in reaching out to the communities using various communication channels and strategies. This could address the challenges associated with the lack of cooperation with local traditional leaders, because this has been found to have a negative impact on implementation of some programmes such as circumcision. One of the positive findings from the study is the accessibility of health care facilities to the local rural communities. Further research on the subject should be undertaken to ensure continuous evaluation as this topic is viewed as a continuous global issue.

In terms of the South African Schools Act, all schools are now required to have School Government Bodies to compliment the formal school administrative structures. The research looks at how these bodies have functioned in a rural context. The empirical evidence, supported by other research evidence show that even though these bodies are sometimes dutifully constituted in schools, their functionality and effectiveness remains limited due to a number of reasons. This research study has shown that the ineffectiveness of SGBs in a rural context is attributed to that following key issues- firstly, there is limited knowledge of the functions of SGB, which can be traced to the lack of training on the body member; secondly, there is a inadequate framework in many public schools to engage with the SGBs; and finally there is a lack of school resources to make effective use of these bodies.

This research study has shown that the ineffectiveness of SGBs in a rural context is attributed to that following key issues- firstly, there is limited knowledge of the functions of SGB, which can be traced to the lack of training on the body member; secondly, there is a inadequate framework in many public schools to engage with the SGBs; and finally there is a lack of school resources to make effective use of these bodies.

The study also found out that communication will be effective if messages are received as intended by the sender. Conclusively, the study notes that stakeholders should be included in decision making processes in the organisation and that if their needs are also catered for, this will make them to be fully involved in understanding organisational concerns positively.

Involvement of the grade 8 teacher is relevant to determine the voice from a Grade 8 teacher as an informed voice, which filtered into understanding how and why Grade 9 learners are unable to read and write with understanding in their present grade. The teachers were given three questions for semi-structured interviews. All the learners were given a specific activity as a pre-assessment without intervention strategy. The Grade 9(a), which is the intervention class, used story writing as an intervention strategy where they began a two week study using intensive intervention strategies, amounting to a total of 18 weeks study from pre-assessment to post-assessment. At the conclusion of the study the selected learners undertook a post-assessment using the same specific activity as in the pre-assessment. Subsequently, these selected Grade 9 learners’ reading comprehension pre-assessment and post-assessment was analysed. Five of the grade 9(a) learners demonstrated significant improvement in the intervention activities they were given. Grade 9(b) and Grade 9(c) showed difficulty in the post-assessment as they were the non-intervention group. It was concluded that Grade 9(a) learners performed better in the post-assessment. The interpretive paradigm was utilised in this study because it focuses on individual perceptions and experiences. In addition a qualititative approach was employed for the collection of data since it allowed for triangulation of data collection techniques so as to gain in-depth and rich information on the career trajectory of female academics in South African and Zimbabwean universities. Therefore, semi-structured interviews, focus group interviews and document analysis were employed. The participants were purposively selected for the sample of this study and comprised of 5 senior female academics from each university and 5 junior female academics also representing each university respectively. Thematic content analysis was used to analyse data and this was carried out in line with the research questions, aims and objectives of the study. Through the participants' answers from both universities under study, a transcript was formulated, coded and categorised in view of the career development of female academics in South African and Zimbabwean universities. It was discovered from the data that the female academics still encounter a number of challenges with regard to their career mobility both in and out of academia inter alia, (1) gender stereotyping and male domination (2) knowledge retention (3) lack of mentorship and organisational support especially through funding and professional staff development programmes (4) lack of female solidarity (5) under-representation of female academics (6) teaching workloads and research publications and (7) lack of family support, were illuminated by the participants as common fixtures that hinder their career development in academia. Moreover, there were variances in both universities under study especially with relations to funding, gender policies in place and male domination. Consequently, the above mentioned factors were more pronounced in Zimbabwean universities than in South African universities. As a result, emphasis was that both South African and Zimbabwean universities have to draw a line between theory and practice especially on the professional staff development programmes that are offered to the academics. A crucial observation was made by the researcher on how most of the participants from both universities under study had negotiated their roles as mothers, wifes, academic and sisters in a bid to realise career growth, such that striking a balance between work and family posed a continuous hindrance their career development. As a result, hard work, commitment, confidence, self-assertiveness and sacrifice cut across both universities as strategies used if the battle of career development of female academics had to be won. In sum, this study attempted to illuminate the perceptions and experiences of female academics and what it means to be a female academicin the 21st century universityn and why there is a need to create, cultivate and have a conducive and supportive working environment. Moreover, promotion of knowledge expansion and sharing, gender equity and equality needs to be employed by both universities under research. Additionally, the professtional staff development programmes offered need to be conducted by qualified and experienced personnel in a bid to avoid repetition of workshops and training programs. Furthermore, formalisation of mentoring and role modelling should also be employed by South African and Zimbabwean universities. Lastly, the study recommended that there is a need for universities source out resources for its academics if there are to produce well rounded scholars who will be able to experience career development.
