An evaluation of the impact of the provincial housing policy in the Nxuba Municipality

- Description: The Eastern Cape Department of Housing has a constitutional and legislative mandate to provide houses to the poor and disadvantaged citizens living within the province. Parliament must also, according to the Constitution of the Republic of South Africa, 1996, as amended, take reasonable legislative and other measures within its available resources to achieve the progressive realisation of the right of citizens to have access to adequate housing (section 26 (1) and (2)). The commitment to improve the existing housing situation, namely the serious lack of adequate housing and basic services in urban townships and rural settlements, is thus in the first instance a policy matter and secondly a financial matter. However, despite the existing policy measures, such as the Housing Act, 1997 (Act 107 of 1997), the rendering of housing services resulted in uncompleted and defective houses due to inexperienced contractors providing poor workmanship and also corruption in the housing programmes. The rendering of housing services as a functional area has constitutionally been given to the national and provincial legislatures in South Africa. The Constitution allocated this function to the local sphere of government. Municipal authorities are the facilitators of sustainable housing services to (xiv) citizens on behalf of the national and provincial spheres of government. The study was thus conducted within the Nxuba local municipality which is one of eight local municipalities in the Amathole district municipality. The purpose of the study was to evaluate the implementation of the provincial housing policy and to determine the impact of the existing policy on the housing needs of the citizens of the Nxuba local municipality. For this purpose the fundamental and overall study problem was found to be that the rendering of housing services at the Nxuba local municipality is hampered by the implementation of an inadequate provincial housing policy and by incompetent municipal personnel and that these actions do not satisfy the growing demand for sustainable and suitable housing. The hypothesis was furthermore based on the fact that the existing provincial housing policy is inadequate to satisfy human needs and impacts negatively if not harmfully on human well-being. The study revealed that besides the implementation of an inadequate housing policy by incompetent municipal personnel, there are economic, social, political, physical and environmental effects on the citizens. As far as the environmental is concerned, the staging of protest marches resulting in the burning of tyres, rubbish cardboards and road barricades had caused serious air pollution which might lead to the spread of diseases such as TB, cancer and bronchitis when people inhale the poisonous gas evolving from smoke such as carbon monoxide (CO) and sulphur dioxide gases. Secondly, there is an economic impact on the citizens. Houses have been built away from town and people are compelled to commute between the town and their place of residence on a daily basis. With a continuous increase in the petrol price and its associated increase in transportation costs people pay large amounts to get to town. Furthermore the building of the RDP houses frequently comes to a standstill, builders, plumbers and carpenters lose their jobs. People’s income levels fall, impacting negatively on economic activity.

- Description: The purpose of the study was to evaluate the impact of implementing capacity building strategies on the provision of health services in the central region of Malawi. The study intended to determine why a lack of quality services is still prevailing in the health services in the central region despite implementing capacity building strategies aimed at improving the delivery of health services. In addition to this, to come up with recommendations to improve the implementation of the existing capacity building strategies so that the implementation results in the intended impact, that is efficient and effective provision of health services in the central region of Malawi. The studies reviewed what various scholars have written on capacity building in order to ground capacity building in Public Administration and provide the study with a conceptual, theoretical and legislative framework. This enabled the researcher to describe the nature and place of capacity building in Public Administration. It was evident from the review that the implementation of capacity building strategies is a systematic process which requires that chief officials follow all the steps in order to effectively and efficiently implement the capacity building strategies so that the intended impact is achieved. In this regard, capacity building is a management function which requires that chief officials play an enabling role by providing the necessary resources (both human and financial) and policies that support the implementation of capacity building strategies. The study used both quantitative and qualitative research methods whereby thirty-five respondents composed of political office-bearers and chief officials from Lilongwe, Dedza, Mchinji and Dowa districts and Ministry of Health Headquarters in the central region of Malawi were given self-administered questionnaires to complete. Face-to-face interviews and document analysis were also used as research methods. The intention was to determine the problems that are being experienced in the implementation of the existing capacity building strategies and find out if the strategies are resulting in the intended impact. The study findings confirmed that there are indeed problems being experienced in the implementation of the existing capacity building strategies, namely: inadequate human and financial resources, corruption, political interference, lack of consultation with stakeholders and lack of political will to make sure that the implementation of the capacity building strategies is effectively and efficiently done. It was also revealed that the implementation of the existing capacity building strategies is impacting negatively on the provision of health services in the central region of Malawi, hence indicating a need to change in approach. The study concludes that in order for the capacity building strategies to achieve the intended impact there is a need to broaden the scope of the legal framework on health capacity building strategies in Malawi, enforce the use of performance standards and improve the operational framework to gain efficiencies and effectiveness from current investments in capacity building.

The importance of conducting the research is discussed and the limitations of the study are discussed in the research. Importantly, the study plan directs the researcher in the direction towards the goals of the research. Also the terms used in this study that are not clear were defined to avoid misinterpretation; misunderstanding and confusion of words and terms. The review of the current literature on the theoretical framework and the base for policy making and controlling role of municipal political office-bearers and chief officials in public administration was discussed. The nature of systems theory and the different phases of systems theory were explained. The nature and place of policy making in public administration was discussed as well as policy making alternatives in the public sector. The policy making levels i.e. political policy making level; executive policy making level; administrative/departmental policy making level; operational policy making level were explained and discussed. The co-operative interaction between municipal political office-bearer and chief officials was discussed to understand the administrative and political dichotomy in the public sector. The policy implementation for the rendering of housing services as well as the programming and delegation of authority were discussed in the context of housing service delivery. The legislative framework for housing services in South Africa was discussed as it influence and affects the housing service in King Sabata Dalindyebo Municipality. The role of municipal authorities in the rendering of housing services as well as the housing situation in South Africa together with the obligations of both the provincial and municipalities were discussed. The permission to conduct research was received from King Sabata Dalindyebo local municipality. The scope of the study explains the range or extent of matter to be dealt with in the research and the survey area is dearly provided. The research design which is qualitative and quantitative research are discussed and used in adopting the study. The case study as research strategy is discussed and clarified. The data collection instruments which are interviews, questionnaires and the literature study the subject were briefly explained. Population details and sampling were clearly explained before a sample is provided in the study. The research provides data collection procedures as well as how the data will be analysed. The ethical considerations are discussed. The data analysis and interpretation was conducted to enable the researcher to identify patterns which are consistent within the data. The criteria for data analysis as well the response rate were discussed. The demographics of chief officials and political office-bearers as respondents include their age; year of service, home language, gender, the academic qualification as well as the different stakeholders were analysed. The role of political office-bearers and chief officials in the initiation of policy which the input phase of the Systems theory analysis was conducted and the role of political office-bearers and chief officials in the process phase were analysed and discussed. The co-operative interaction in policy formulation and the steps in the policy formulation were analysed and discussed. Also the analysis was conducted on the delegation of authority to chief officials by the political office-bearers as well as the role of political office-bearers and chief officials in the approval of executive policy. An evaluation of the rendering of - 11 - housing services at Phola park informal settlement as well as the evaluation of housing services as an output phase in policy formulation were analysed and discussed. And lastly, the analysis of the impact of existing legislation or policy on housing services was conducted. The findings of the study were provided and discussed and the concluding remarks were provided to whether the problem is real and whether the hypothesis is true and valid. The recommendations of the study were provided to enable Kind Sabata Dalindyebo local municipality to improve the co-operative interaction between municipal political office-bearers and chief officials to improve housing services and to provide better service delivery. The role of municipal authorities in the rendering of housing services was discussed. The permission to conduct research was received from Intsika Yethu local municipality on the 13 October 2009 from the Municipal Manager. The research design was explained together with research approaches and strategy as qualitative and quantitative. The research methodology with a clear population and sampling for the study as well as the data collection instruments and procedures as questionnaires; literature study and interviews were explained. The ethical considerations are discussed. The data analysis and interpretation was conducted to enable the researcher to identify patterns which are consistent within the data. The theory and techniques for data analysis was discussed to link the theory and data analysis. The demographics of chief officials and political office bearers as respondents include their age; year of service, home language, gender, the academic qualification as well as the different stakeholders were analysed. The housing as essential services in the initiation of policy which the input phase of the Systems theory analysis was conducted and the data on the nature of housing services as output phase were analysed and discussed. The data on the structural problems were analysed and discussed. Also the analysis was conducted on the legislative framework for housing x services. The problems with the rendering of housing services especially administrative enabling problems as a processing phase in the policy process were analysed and discussed. And lastly, the possible solutions to the solving of housing problems were discussed and analysed. The findings of the study were provided and discussed and the concluding remarks were provided to whether the problem is real and whether the hypothesis is true and valid. The recommendations of the study were provided to enable Intsika Yethu Local Municipality to improve the housing service provisioning and ultimately to provide better service delivery.

The introduction provides the general overview of the study and provides a background to the intention of the research to evaluate the housing services provision in the municipality. The problem statements briefly describe the problem identified in the study and the objectives of the study are set. The theoretical framework is provided and the theories used to evaluate the housing service are discussed which are institutional theory and the system theory. The importance of conducting the research is discussed and the limitations of the study are discussed in the research. Importantly, the study plan directs the researcher in the direction towards the goals of the research. Also the terms used in this study that are not clear were defined to avoid misinterpretation; misunderstanding and confusion of words and terms. The review of the current literature on the theoretical framework and the nature and place of public administration was discussed. The policy process and the nature and place of policy making as well as steps in policymaking were discussed. The nature and place of policy implementation which includes all the functions was discussed in the study. The policy analysis and evaluation as the final step in the policy process including the stages in policy analysis and evaluation i.e. input phase; processing and conversion phase; output phase, impact/effect phase were discussed The legislative framework for rendering of housing services in South Africa was discussed as it influence and affects the housing service rendering in Intsika Yethu Local Municipality. The role of municipal authorities in the rendering of housing services was discussed. The permission to conduct research was received from Intsika Yethu local municipality on the 13 October 2009 from the Municipal Manager. The research design was explained together with research approaches and strategy as qualitative and quantitative. The research methodology with a clear population and sampling for the study as well as the data collection instruments and procedures as questionnaires; literature study and interviews were explained. The ethical considerations are discussed. The data analysis and interpretation was conducted to enable the researcher to identify patterns which are consistent within the data. The theory and techniques for data analysis was discussed to link the theory and data analysis. The demographics of chief officials and political office bearers as respondents include their age; year of service, home language, gender, the academic qualification as well as the different stakeholders were analysed. The housing as essential services in the initiation of policy which the input phase of the Systems theory analysis was conducted and the data on the nature of housing services as output phase were analysed and discussed. The data on the structural problems were analysed and discussed. Also the analysis was conducted on the legislative framework for housing x services. The problems with the rendering of housing services especially administrative enabling problems as a processing phase in the policy process were analysed and discussed. And lastly, the possible solutions to the solving of housing problems were discussed and analysed. The findings of the study were provided and discussed and the concluding remarks were provided to whether the problem is real and whether the hypothesis is true and valid. The recommendations of the study were provided to enable Intsika Yethu Local Municipality to improve the housing service provisioning and ultimately to provide better service delivery.

- Description: This thesis explored the pernicious effects of financial fraud and corruption and the importance of the rule of law, transparency and accountability of public sector. These critical conditions serve as the foundation for the effective and efficient governance and the economic growth of a nation, especially through utilizing the opportunities provided by globalization through increased investment and trade. The thesis looks at the importance of upholding the rule of law and fostering transparency and accountability in the public sector in combating financial fraud and corruption, particularly as components of effective national strategies. The rule of law, transparency and accountability in the public sector serve not only as means to counter financial fraud and corruption but also as fundamental conditions of effective governance. It was discovered that financial fraud and corruption is a complex phenomenon, present in all countries. Its causes are engendered by conditions of underdevelopment. Hence, its effects hinder and impede the development process itself. It was also confirmed that financial fraud and corruption are co-determined by many other factors, including cultural and moral values. The motivation to remain honest may be weakened by low public official’s salaries, promotion of personnel unconnected to performance, dysfunctional government budgets, loss of organizational purpose, bad example by chief official’s and political leaders, or long established patron-client relationships, in which the sharing of bribes or the exchange of favors has become entrenched. Financial fraud and corruption can be highly concentrated at the top of a political system and associated with political power, or broadly based at lower levels in the system, associated with administrative processes and discretionary powers. Hence, bribes can be blatant or subtle and take many different forms, including cash payments, job offers, scholarships, foreign trips or political and other favors. Furthermore, the development of sustainable local authorities however is an ambitious issue that requires local authorities to focus on the improvement of the quality of life of present and future communities without depleting the natural resources at their disposal. For sustainable and equitable development, this study espouses on the far-reaching implications for local authorities through multiple regression analysis due to various economic, social and institutional challenges that have to be taken into consideration when a process to promote sustainable development is considered. To comprehensively actualize the implications of financial fraud and corruption on the sustainable development of local authorities, a multistage cluster sampling, a form of probability sampling technique was adopted. Semantically, to identify the research paradigms suitable for this study, a hybrid approach to research design was used (quantitative and qualitative). This however enables the impact of financial fraud and corruption on the sustainable development of selected local authorities in South Africa to be ascertained. Moreover, the study explores the circumstances and implications surrounding financial fraud and corruption in the local authorities in South-Africa. Financial fraud and corruption tends to emerge when an organization or a public official has monopoly power over a good or service that generates rent, has the discretionary power to decide who will receive it, and is not accountable. Financial fraud and corruption’s roots are grounded in a country’s social and cultural history, political and economic development, bureaucratic traditions and policies. This study also identifies that, direct and indirect factors promote financial fraud and corruption. Direct factors include regulations and authorizations, taxation, spending decisions, provision of goods and services at below market prices, and financing political parties. On the other hand, quality of bureaucracy, level of public sector wages, penalty systems, institutional controls, and transparency of rules, laws, and processes are the indirect factors that promote financial fraud and corruption. Financial fraud and corruption is a symptom of deep institutional weaknesses that leads to inefficient economic, social, and political outcomes. It reduces economic growth, retards long-term foreign and domestic investments, enhances inflation, depreciates national currency, reduces expenditures for education and health, increases military expenditures, misallocates talent to rent-seeking activities, pushes firms underground, distorts markets and the allocation of resources, increases income inequality and poverty, reduces tax revenue, increases child and infant mortality rates, distorts the fundamental role of the government (on enforcement of contracts and protection of property. Nonetheless, this study concludes that financial fraud and corruption impedes economic efficiency which could slow or shrink economic growth. This will adversely affect all income classes, especially the most vulnerable, the poor. The effect of financial fraud and corruption through investment expenditure on health and education critical to sustainable development was noted in this study. In practice, the distinction between governance and government and the resultant mechanisms directed at local sustainable development do not seem to be clear. Hence, lack of understanding of the meaning of sustainability and governance for local development is still lacking. - Description: The rural areas of Amathole district municipality continue to experience difficulty in accessing water services. The people experience problems despite the fact that the Amathole district municipality, since 2003 has been made a water service authority in its municipal area, which consists of eight local municipalities, namely; Mnquma, Mbashe, Nkonkobe, Amahlathi, Great Kei, Ngqushwa, Nxuba, and Buffalo City. With the water service authority powers devolved from national government to the district municipalities the intention was to speed service delivery. This study investigates the causes of the delays in water service delivery experienced in rural areas of this district municipality. The Buffalo City local municipality is excluded in the study because Buffalo City has as well been given the responsibility of being the water service authority in its municipal area. This study used the questionnaires as data collection tool, and it was distributed to these respondents; chief officials, councilors, and citizens. Due to vastness of the target population sampling was used to reduce the bulkiness of the data. The questionnaire content is based on the phases of the systems theory to see if the policy making processes of the Amathole district municipality are carried out in accordance with the systems theory. The study has found that the citizens are not adequately involved in all the policy processes including the policy analysis and evaluation. This has been found to be a contributory factor in the ineffectiveness of the municipality water service delivery.The spheres of government that operate in silos compromised policy analysis and evaluation of the municipality, and disjuncture of the delivery programs of the spheres and state enterprises caused a huge service delivery challenges for this municipality. The study has confirmed that the Amathole district municipality is experiencing problems, delays, and challenges that make it to be ineffective as a water service authority.

- Description: In this study, it was attempted to gain insight on coordination of decentralized health and social development services. Further, it was attempted to evaluate the coordinating arrangements of and relationship between decentralized provincial health and social development services with similar services rendered by district and local municipalities. Since the literature on coordination of decentralized services is limited, it is anticipated that this study will provide valuable information for further research on the topic. In the literature study undertaken however, it was evident that coordination of services increases the rate of effectiveness and efficiency in the delivery of public services. It was found that role players can no longer afford to work in different compartments. They need to work cooperatively together in achieving unity of purpose, unity of effort as well as unity of action towards the realization of the objectives of government, that of rendering of public services. Thirty four respondents composed of mayors in Amathole District Municipality and Buffalo City Local Municipality, municipal managers for the respective municipalities, portfolio heads for health and social development services in the respective municipalities as well as two councillors, one in each municipality, were given questionnaires to complete. Also given questionnaires to complete were the political office bearers of the Provincial Department of Health and the Provincial Department of Social Development as well as respective Heads of the two departments. Again, officials of the five decentralized offices of the Provincial Department of Health and the Department of Social Development namely, Mbashe, Mnquma, Buffalo City, (v) Amahlathi and Nkonkobe, were given questionnaires to complete. The intentions of the study were to determine the effectiveness in coordinating the rendering of health and social development services between the Provincial Authority, the district as well as local municipalities in the Eastern Cape. Also, the intention was to determine the problem areas in the coordination of the health and social development services rendered by the above authorities. Lastly, the intention was to ascertain whether or not proper measures and standards are put in place for the effective coordination of health and social development services rendered by the above authorities. The findings of the study confirmed firstly, that there is a need to coordinate decentralised health and social development services with similar services rendered by district and local municipalities as well as other role players. Secondly, the study confirmed that departments and municipalities experience problems of coordinating decentralised health and social development services. Thirdly, the study confirmed that there are measures in place to coordinate decentralised health and social development services with similar services rendered by municipalities and other role players. Lastly, the study confirmed, that such measures are not properly defined and need to be strengthened.

- Description: The Eastern Cape Department of Education has a constitutional and legislative mandate to provide quality public education in all public schools within the province. The commitment to improve also involves ensuring effective educator personnel provisioning in public secondary xii schools. However, despite various legislative and policy measures relating to educator personnel provisioning, serious concerns have been raised. There have been concerns over the shortage of educators. There are concerns over the lack of suitably qualified educators, especially in Mathematics and Science subjects. Disparities have been noted between legislative and policy directives with regard to educator personnel provisioning and the expectations of educators based on the realities in public secondary schools. The complications and challenges thereof have called upon for the appraisal of educator provisioning. The objective of the study is to describe and explain the nature and place of personnel provisioning in public secondary schools. Thereafter, evaluate its application at selected public secondary schools in the Eastern Cape Province. The basic intention is to prove that the educator personnel provision policy implementation in public schools needs to be examined and possibly changed for effective results. Basically, personnel provisioning is the first step in the personnel process. It is classified into: Human resources determination; and the Filling of posts The process of filling public personnel posts involves recruitment, selection, appointment, placement, transfer and promotion. In evaluating personnel provisioning policy in public secondary schools, a research study has to be conducted. As an integral part of scope of study, the survey area includes public secondary schools, provincial department offices and educator union/association offices. The questionnaire is used as the appropriate data collection instrument for this survey. The total population for the study are provincial department officials, public secondary school principals, school governing body chairpersons and educator unions/associations. xiii When data was analysed and interpreted, there were various significant findings. The respondents’ demographic details provided a significant insight into the study and its findings. They ensured divergence of opinions and understanding of the personnel provisioning. Regarding human resources determination and the filling of posts in public secondary schools, it was found that there are challenges in terms of the employment of suitably qualified educators. These include among other issues educator dissatisfaction and lack of effective procedures in the filling of posts. This also results in educator shortage in public secondary schools.
