- Description: The world needs entrepreneurs now more than ever; fresh thinkers, who spot opportunities and apply their talents to overcome obstacles to make their ideas happen. Entrepreneurs need to reframe the recession as an area of business opportunity for all. They must unleash their innovative ideas around the world and inspire solutions that will tackle issues ranging from poverty, unemployment and climatic change. It is the fundamental precept of the Christian faith that God calls not only ministers and other spiritual workers, but everyone to specific roles in his kingdom. Christian Entrepreneurs must realise that their calling to establish and lead business organisations that are designed to achieve results in the secular world. Christian Entrepreneur Organisations differ from secular businesses because they do business while being led by the Holy Spirit. Christian Entrepreneurship is the return of unfulfilled business leaders to the sense of "calling" enjoyed by fellow laity in the U.S.A. and Western Europe prior to the 20th Century. The goal is to develop a business that blends business excellence and entrepreneurship with Christian Biblical and theological perspectives. This exploratory study investigated the role of the Christian faith in Entrepreneurship and in Entrepreneurial businesses. The study identified some of the Christian business practices and introduced the reader to the different approaches this group of entrepreneurs have to that of the secular business equivalent.

This study examines the whether it would be feasible to expand its operations into the USA, namely into the California area where a squid fishery exists. The study further centres around the company’s existing markets, namely Spain and Italy, to establish whether demand exists to purchase this Californian squid specie. The reason for the study is that due to legislative and political issues growth in the squid industry in South Africa is limited. It is therefore considered pertinent to source further supply of product in order to expand its business. The aim of the study is establish whether it is feasible to expand the company’s operations internationally and does the outcome of this initial study warrant the development of an in depth business plan. In order to achieve these objectives the following approach was followed: A comprehensive literature study was conducted with regard to the industry internationally and locally; Interviews was conducted with independent experts such as attorneys and industry role players situated in California; Potential sellers of businesses were sourced in the California and interviews were arranged with these role players; The response to the interviews was measured against the literature study conducted and financial statements supplied.

Characterisation of the plasmodium falciparum Hsp40 chaperones and their partnerships with Hsp70

- Description: Central to this research, 40 kDa Heat shock proteins (Hsp40s) are known to partner (or cochaperone) 70 kDa Heat shock proteins (Hsp70s), facilitating the selection and transfer of protein substrate to Hsp70 and the stimulation of the protein folding ability of Hsp70. Members of the diverse Hsp70-Hsp40 protein complement of Plasmodium falciparum have been implicated in the cytoprotection of this malaria parasite, and are thought to facilitate the protein folding, assembly and translocation tasks required by the parasite to commandeer the infected human erythrocyte subsequent to invasion. In particular, the parasite has evolved an expanded and specialised 43- member suite of Hsp40 proteins, 19 of which bear an identifiable export motif for secretion into the infected erythrocyte cytoplasm where they potentially interact with human Hsp70. Although type I Hsp40 proteins are representative of typical regulators of Hsp70 activity, only two of these proteins are apparent in the parasite’s Hsp40 complement. These include a characteristic type I Hsp40 termed PfHsp40, and a larger, atypical type I Hsp40 termed Pfj1. Both Hsp40 proteins are predicted to be parasite-resident and are most likely to facilitate the co-chaperone regulation of the highly abundant and stress-inducible Hsp70 homolog, PfHsp70-I. In this work, the co-chaperone functionality of PfHsp40 and Pfj1 was elucidated using in vivo and in vitro assays. Purified recombinant PfHsp40 was shown to stimulate the ATPase activity of PfHsp70-I in in vitro single turnover and steady state ATPase assays, and co-operate with PfHsp70-I in in vitro aggregation suppression assays. In these in vitro assays, heterologous partnerships could be demonstrated between PfHsp70-I and the human Hsp40, Hsj1a, and human Hsp70 and PfHsp40, suggesting a common mode of Hsp70-Hsp40 interaction in the parasite and host organism. The functionality of the signature Hsp40 domain, the Jdomain, of Pfj1 was demonstrated by its ability to replace the equivalent domain of the A. tumefaciens Hsp40, Agt DnaJ, in interactions with the prokaryotic Hsp70, DnaK, in the thermosensitive dnaJ cbpA E. coli OD259 deletion strain. An H33Q mutation introduced into the invariant and crucial HPD tripeptide motif abrogated the functionality of the J-domain in the in vivo complementation system. These findings provide the first evidence for the conservation of the prototypical mode of J-domain based interaction of Hsp40 with Hsp70 in P. falciparum. Immunofluorescence staining revealed the localisation of PfHsp40 to the parasite cytoplasm, and Pfj1 to the parasite cytoplasm and nucleus in cultured intraerythrocytic stage P. falciparum parasites. PfHsp70-I was also shown to localise to the parasite cytoplasm and nucleus in these stages, consistent with the literature. Overall we propose that PfHsp40 and Pfj1 co-localise with and regulate the chaperone activity of PfHsp70-I in P. falciparum. This is the first study to identify and provide evidence for a functional Hsp70-Hsp40 partnership in P. falciparum, and provides a platform for future studies to elucidate the importance of these chaperone partnerships in the establishment and survival of the parasite in the intraerythrocytic-stages of development.

The role of reasonableness in the review of labour arbitration awards

- Description: The Labour Relations Act 66 of 1995 in section 145 and the Arbitration Act 42 of 1965 in section 33 uses wording very similar to one another to specifically enable the labour court to review CCMA and private arbitration awards respectively. As a result, labour arbitration award reviews are regarded as part of the family of special statutory reviews; the implication of such a classification being that the situation specific statutory provision(s) and the jurisprudential principles developed thereunder are applicable rather than those applicable to reviews in general. When the common purpose of the review procedure is then read with the legislature’s objective of quickly and finally resolving labour disputes at arbitration level as well as the limited grounds for review as provided for in the LRA and the AA, indications are that the labour courts’ review powers should be restrictively interpreted. However, because the making of CCMA arbitration awards also constitutes administrative action, the review thereof is also influenced by the constitutional right to just administrative action and reasonableness in particular. This does however not mean that applicants on review can rely directly on section 33 of the Final Constitution or on the broader grounds of section 6 of the PAJA to review CCMA arbitration awards on the basis of unreasonableness. Section 145 of the LRA constitutes administrative action legislation within the specialised labour law sphere and reasonableness is not a ground mentioned therein. A constitutionally consistent interpretation of section 145 however has the effect that reasonableness suffuses the statutory defined grounds for review; a state of affairs that does not threaten the restrictive scope of CCMA arbitration award reviews. In terms thereof, courts on review must establish whether the decision, alleged to have been reached by the commissioner as a result of the occurrence of one or more of the section 145 grounds for review, is one that a reasonable decision-maker could not reach. This interpretation accords far better with the legislature’s specific objectives pertaining to labour arbitration award reviews and the permissible range of reasonableness further ensures that awards are not easily interfered with on review. When a court is then called upon to determine whether or not a decision is reviewable in terms of section 145, it is entitled to have regard to both the award and the record of the proceedings. If, after such scrutiny, the court is of the opinion that the decision was arrived at as a result of the occurrence of a defect as contemplated by section 145 of the LRA, the decision should be reviewed and set aside irrespective of the fact that the outcome can be sustained by other reasons also identifiable from the record; the focus of review always being on the commissioner’s process of reasoning and the way in which he arrived at his findings rather than the outcome of the process. A court should however be mindful of the fact that erroneous reasons for findings per se are not reviewable grounds, but at best serve as evidence of a reviewable ground that will in conjunction with other considerations have to be sufficiently compelling to justify an inference that the decision is unreasonable. In the case of jurisdictional reviews, the reasonableness standard is also applicable because the focus is on the commissioner’s subjective reasons for his findings rather than the jurisdictional fact’s objective existence. A court on review can accordingly set aside a decision following upon the non-observance of a jurisdictional fact if the commissioner, in deciding that the jurisdictional fact existed, committed one or more of the section 145 grounds for review. In the case of private arbitration awards, applicants seeking a review must do so on the grounds recognised in section 33 of the AA and reasonableness is not one of them. This is however not the only reason why these awards are also not subject to the scrutiny of the reasonableness test on review. The other reason relates to the fact that the issuing of private arbitration awards does not constitute administrative action. - Description: This thesis argues that the modern notion of free-speech was born within the Westphalian nation-state. It suggests that the legal rights framework - particular to the Westphalian nationstate - not only legitimizes and legalizes the right to free-speech, but also enables us to invoke legally the necessary limitations that demand the limitation of free-speech in certain contexts. However, such a legal-rights framework is exclusive to the nation-state and cannot be enforced on an international level, outside of the nation-state boundary. With reference to examples on an international level, this thesis demonstrates that calls for the limitation of free-speech are indeed legitimate and necessary but cannot be enforced on an international level for the reasons just mentioned. In order to address this problem, this thesis proposes a framework - based on a Kantian model - that enables us to invoke the limitation of free-speech on an international level without appealing to a legal-rights discourse to do so.

- Description: Since the introduction of the Choice on Termination of Pregnancy Act in 1996, research concerning abortion has primarily focused on public health issues or on the personal experience of women. The cultural and social context within which women experience a termination of pregnancy and in which services are offered has received less attention. The purpose of this study was to analyse public discourses around abortion in a low-income community in the Western Cape. Focus groups were used to gather data from three women’s and three men’s groups. - Description: Since the introduction of the Choice on Termination of Pregnancy Act in 1996, research concerning abortion has primarily focused on public health issues or on the personal experience of women. The cultural and social context within which women experience a termination of pregnancy and in which services are offered has received less attention. The purpose of this study was to analyse public discourses around abortion in a low-income community in the Western Cape. Focus groups were used to gather data from three women’s and three men’s groups. This thesis is a pre-release evaluation of C. aquaticum to determine whether it is sufficiently damaging to water hyacinth to warrant its release. It investigated interactions between the grasshopper and water hyacinth under a range of nutrient conditions found in South African water bodies as well as the impact of the grasshopper on the competitive performance of water hyacinth. Both plant growth rates and the response of water hyacinth to herbivory by the grasshopper were influenced by nutrient availability to the plants. The ability of water hyacinth to compensate for loss of tissue through herbivory was greater under eutrophic nutrient conditions. However, a negative linear relationship was found between grasshopper biomass and water hyacinth performance parameters such as biomass accumulation and leaf production, even under eutrophic conditions. Water hyacinth’s compensatory ability in terms of its potential to mitigate to detrimental effects of insect feeding was dependent on the amount of damage caused by herbivory by the grasshopper. Technology has improved, innovative ways of utilising nuclear power have been developed, new chemicals have been introduced to the market and the adverse effects of other chemicals on both human health and safety and the environment have been discovered. This has influenced the nature of the workplace itself. While employees enjoy a common law right to a safe working environment and health and safety, state intervention currently provides restricted claims to an employee who has sustained injuries or contracted occupational diseases. This thesis explores the effect of section 35 of the Compensation for Occupational Injuries and Diseases Act 130 of 1993 which deprives an employee of its common law right to institute civil action against an employer for an injury sustained or disease contracted during the course and scope of employment. Furthermore, this thesis also explores the marriage between the Occupational Health and Safety Act 89 of 1993 and the Compensation for Occupational Injuries and Diseases Act 130 of 1993 as well as the position of ‘employee’ and ‘employer’ insofar as the scope and application of these two acts are concerned with specific reference to the position of labour broker employees. The use of indemnity clauses and its validity in South Africa will also be explored and discussed. This thesis also dedicates a chapter to the leading case authority of Jooste v Score Supermarket Trading (Pty) Ltd and its effect insofar as the enforcement and application of section 35 of the Compensation for Occupational Injuries and Diseases Act 130 of 1993 is concerned. It is impossible to mention all the changes in the workplace that have occurred in the recent years, and this discussion therefore focuses on the current position of employees who have been deprived of their common law right to institute delictual action for damages resulting from an injury sustained while on duty as well as the impact of the current restrictive claims available to them. Alterations to existing approaches are also proposed to resurrect the common law right of employees to institute action against their employers. , Abstract

The writer has employed a qualitative method. Four focus groups were arranged by the researcher at Nelson Mandela Metropolitan University. All participants of the study were Nelson Mandela Metropolitan University (NMMU) undergraduate and postgraduate black students aged 21-35. The sample of this study included fifty participants. Thus the researcher has utilized a purposive sampling technique. Participants were encouraged by the researcher to have maximum participation in the focus group deliberations. The researcher also made use of elite interviews in the study. The findings of this study suggest that political apathy amongst students at Nelson Mandela Metropolitan University does exist. Most of the participants in the focus groups indicated that young people in post-apartheid South Africa have no interest in politics.

The aim of this study was to describe some characteristics seen at various scales (macro-, micro- and ultra -) within nodules that might contribute to an understanding of aspects of nodule formation and the reasons for the excellent preservation of the fossil material within these nodules. Detailed, high quality macro-photographs were taken of sliced and whole nodule surfaces and a catalogue was produced to tentatively identify fossils present and illustrate the variations seen within nodules. Selected nodules were then subjected to petrographic, ultra-structural (SEM) and some chemical (EDS, XRD & XRF) analysis to investigate the possible reasons for these variations. The chemical results have indicated that nodules are enriched with quartz compared to the surrounding shale. Quartz is also the dominant mineral replacing trilobite carapace material within nodules, while trilobite material within shales is replaced with equal proportions of hematite, biotite and quartz. It appears that the higher resistance of quartz to weathering is the dominant factor leading to the preservation of both nodules within the shales and trilobite material within the nodules examined. A comparison with some Western Cape nodules highlighted possible variations in overall nodule chemical composition along strike. Western Cape nodules are predominantly composed of apatite whereas the Cockscomb nodules are mainly composed of quartz. This quartz-apatite compositional variation in nodules occurring within a single formation has been reported from nodules found in the Armorican Massif of France which are very similar in a number of respects to the Bokkeveld nodules described in this study. Based on various features of the fossils present and the structure of nodules they were probably formed during early diagenesis within an epeiric marine deposit greatly affected by sea level fluctuations.

It appears that the higher resistance of quartz to weathering is the dominant factor leading to the preservation of both nodules within the shales and trilobite material within the nodules examined. A comparison with some Western Cape nodules highlighted possible variations in overall nodule chemical composition along strike. Western Cape nodules are predominantly composed of apatite whereas the Cockscomb nodules are mainly composed of quartz. This quartz-apatite compositional variation in nodules occurring within a single formation has been reported from nodules found in the Armorican Massif of France which are very similar in a number of respects to the Bokkeveld nodules described in this study. Based on various features of the fossils present and the structure of nodules they were probably formed during early diagenesis within an epeiric marine deposit greatly affected by sea level fluctuations.

The key step in this process is the pyrolysis step which involves the isomerisation of cis-2-pinanol to linalool and requires high temperatures (600-650°C) and is not very selective due to the decomposition of the product itself under these conditions. A client of the CSIR, Teubes Pty. Ltd., is a manufacturer of flavour and fragrance compounds for the local and international fragrance market and expressed an interest in producing linalool since the company would then gain access to other valuable fragrance chemicals via relatively simple processes. Earlier work conducted by AECI, R & D did not meet with much success since the selectivity to linalool was very poor and the process could hardly be deemed as scalable. The main objective of this project was therefore to develop a process for the selective isomerisation of cis-2-pinanol to linalool with minimum by-product formation and using process equipment that could be scaled to full-scale production. Since cis-2- pinanol could not be purchased in sufficient quantities for process development, a process had to be developed for the bench-scale preparation of kilogram quantities of cis-2-pinanol from α-pinene obtained from the client. Although this synthesis formed a minor part of this investigation, several process improvements and innovations were introduced to produce high quality cis-2-pinanol, in very good yields at kilogram scale. A major part of this investigation was the design and set up of a pyrolyis rig capable of operating at elevated temperatures (400 - 750°C) for the evaluation of various process parameters. Various vaporizer, reactor, and condensation systems were evaluated for their ability to cope with the demanding conditions on a consistent basis. The initial part of the investigation was a screening exercise to evaluate various process parameters as well as solvents, materials of construction, catalysts, etc. A comprehensive statistical design was also conducted to determine the critical process parameters and the model obtained was used to predict the optimum conditions required for the preparation of in-specification product on a consistent basis. These conditions were used in the preparation of a 1kg sample which was required by theclient for market evaluation purposes. The use of a novel microreactor system was also evaluated for the pinanol pyrolysis reaction. To our knowledge, this is the first time that a microreactor has been successfully used for this type of reaction in the Fragrance industry and a patent application is being filed by the CSIR. The kinetics of the reaction in both the tubular reactor system and the microreactor system was investigated. Computer modelling studies on both the systems were also conducted. The raw material cost to produce a kilogram of linalool is $1.40. There is a significant margin of 60.8 percent between the raw material cost of linalool and the current selling price ($3.57/kg). This clearly indicates that the project is potentially feasible from an economic point of view and we can now proceed with confidence to the next stage which is the engineering design, building and commissioning of the large scale pyrolysis rig. The rest of the process steps will be conducted on existing equipment currently present at the CSIR’s large scale facility (Imbiza in Isando, Gauteng).

Research methodology and design was done through combination of the four-research types classification in their order of sophistication except the predictive research, namely exploratory, descriptive, and analytical or explanatory researches with a further inclusion of deductive research. The compilation of data through questionnaires was also employed. Perceptions on internal impact to the NMBM due to electricity services restructuring were solicited from the sample of the top management of the NMBM, the intention was to ensure the economies of scale, greater transparency and competition in terms of service delivery were sustained during and beyond Regional Electricity Distributor establishment. Financial position of NMBM as a critical instrument for its progress has to be protected to ensure it fulfils its constitutional development mandate. The findings of the research were in strong support of ensuring operational financial viability; to meet the legitimate employment, economic and social interest of all employees; development and implementation of change management strategies; and NMBM assuming leading role in the process.

- Description: It is widely assumed that the managers of companies behave in a self-interested and opportunistic manner when making the discretionary accounting choices that are applied in the preparation of published financial reports. Empirical research has found evidence for this in the United States, Britain, Spain, France and Australia, amongst other countries. There has, however, been no prior work of a similar nature in a South African context. The purpose of this study is to extend this body of work by examining the relationship between a number of potentially opportunistic (profit-increasing, income-smoothing and solvencyimproving) accounting choices made by the managers of South African listed companies, and growth rates in the share prices of those companies. Data in respect of thirty-nine medium-sized South African listed companies are analysed for evidence of the expected positive relationship between opportunistic accounting choices and share price growth. No evidence is found for this relationship. This may be due to limitations in the research design, inadequacies in the interpretation of the agency theory from which the hypotheses are developed, or a combination of both. Refinements in the research design or a re-interpretation of the theory may be successful in addressing these matters as part of future research efforts.

- Description: The growth of forced migration populations - i.e. the movement of people within and across national boarders as a result of conflicts, disasters, and development policies and projects - has been a defining feature of the twentieth century and will no doubt remain with us well into the twenty-first century (Rutinwa, 2001: 13). Literature searches suggest that the ‘refugee’ constitutes the most powerful label within the forced migration discourse. Published calculations regarding the number of refugees in the world at the end of 2008, range between 15.2 million (UNHCR, 2009: 2) and 13.6 million (World Refugee Survey, 2009: 33). The refugee experience of a small representative population of these figures namely, the Zimbabwean refugees living within the Central Methodist Church (CMC) or Central Methodist Mission (CMM) refugee community, in Johannesburg city centre is the concern of this treatise. From the perspective of the conflict management scholar, the informal and formal conflict management strategies adopted among and between the CMM refugees, have been studied. Analysis of existing literature, interviews conducted with the refugees, as well as hours of experience within the refugee community, substantiate the descriptive study that follows. Guided by the grounded theory approach, research findings have emerged out of the descriptions. The research findings in turn have founded the development of the recommendations that appear in the conclusion to the treatise.

- Description: The present paper will inform about three studies that seek to make a contribution to the area of self-conscious emotions, namely guilt and shame, and their consequences for intergroup relations in a South African context. As with previous research, this research investigated whether belonging to a particular group (i.e. being a white South African) is likely to evoke feelings of collective guilt and collective shame when reminded of the atrocities of Apartheid, even though the individual members did not personally contribute to their group’s negative history. The first study aimed to investigate experimentally the effects of experienced collective ingroup guilt and shame on the desire to make reparation. The second study aimed to test the relationship between guilt/shame and reparation of white South Africans in the field. Furthermore, the second study aimed to account for the dialectical aspects of the intergroup situation by exploring guilt/shame and reparation of white South Africans as expected by young black South Africans (as members of the previously oppressed group). The third study aimed to replicate the differences between experienced guilt/shame/reparation and reported ingroup identification by white South Africans and the expected guilt/shame/reparation from white South Africans and reported ingroup identification by black South Africans as found in the study 2. In addition, the third study aimed to control the antecedents for collective guilt and for collective shame. It also explored the impact knowledge about atrocities of the ingroup (white participants) has on emotions and reparation attitudes and whether perceived status relations at present and in the future impacts the emotions as well general reparation attitudes.

- Description: This study deals with corporate social responsibility (CSR) and focuses on managerial perceptions of CSR at McDonald’s South Africa (SA) and how social responsibility is translated into social practices. The key objectives of the research are: to analyse McDonald’s both internationally and locally in South Africa to establish whether CSR policies exist, then to investigate how these policies are perceived and integrated by outlet managers. Lastly to investigate what kind of social responsibility (SR) involvement, if at all, occurs at outlet level. The research site covers three regions in South Africa, which are the Eastern Cape, Western Cape and Gauteng. The total research sample is 38. 33 interviewees were outlet managers, who were purposively selected, and 5 additional interviews took place with: 2 McDonald’s SA Head Office representatives, 2 interviews with beneficiaries of McDonald’s SR involvement and 1 with the trade union SACCAWU. The research was carried out through questionnaires and semi-structured interviews. The design of this research is based on an interpretive social science approach. The aim of the research was to investigate outlet managers’ perceptions of CSR and social practices present at McDonald’s SA outlets. The key findings of the research indicate that: CSR policies at McDonald’s SA head office are not communicated sufficiently to outlet managers, SR involvement is evident, especially for initiatives focusing on children’s welfare, but far too little occurs at the outlet level. There are also too few checks on social involvement by head office and no formal reporting system is available to the outlets except through an internal magazine, called the Big Mag. There is no official CSR report at McDonald’s SA. The fact that no report exists makes this study more relevant since this research investigates matters pertaining to CSR and social practices. The overall significance of the study is that it brings to the forefront the importance of internal company and external broader regulation which is part of the greater debate of CSR. This is because the analysis of managerial perceptions and implementation of CSR shows some unwarranted discrepancies between policies and practices, locally, nationally and internationally even within the same organisation.

- Description: This study deals with corporate social responsibility (CSR) and focuses on managerial perceptions of CSR at McDonald’s South Africa (SA) and how social responsibility is translated into social practices. The key objectives of the research are: to analyse McDonald’s both internationally and locally in South Africa to establish whether CSR policies exist, then to investigate how these policies are perceived and integrated by outlet managers. Lastly to investigate what kind of social responsibility (SR) involvement, if at all, occurs at outlet level. The research site covers three regions in South Africa, which are the Eastern Cape, Western Cape and Gauteng. The total research sample is 38. 33 interviewees were outlet managers, who were purposively selected, and 5 additional interviews took place with: 2 McDonald’s SA Head Office representatives, 2 interviews with beneficiaries of McDonald’s SR involvement and 1 with the trade union SACCAWU. The research was carried out through questionnaires and semi-structured interviews. The design of this research is based on an interpretive social science approach. The aim of the research was to investigate outlet managers’ perceptions of CSR and social practices present at McDonald’s SA outlets. The key findings of the research indicate that: CSR policies at McDonald’s SA head office are not communicated sufficiently to outlet managers, SR involvement is evident, especially for initiatives focusing on children’s welfare, but far too little occurs at the outlet level. There are also too few checks on social involvement by head office and no formal reporting system is available to the outlets except through an internal magazine, called the Big Mag. There is no official CSR report at McDonald’s SA. The fact that no report exists makes this study more relevant since this research investigates matters pertaining to CSR and social practices. The overall significance of the study is that it brings to the forefront the importance of internal company and external broader regulation which is part of the greater debate of CSR. This is because the analysis of managerial perceptions and implementation of CSR shows some unwarranted discrepancies between policies and practices, locally, nationally and internationally even within the same organisation.
