South African criminal justice : a paradigm shift to victim-centred restorative justice?

- Description: The focal point of this treatise is the evaluation of the paradigm shift that has taken place in our South African criminal justice system post 1994. This shift is seen as a move away from a retribution approach to a more victim-centred approach. One needs to remember that the previous regime had unfair and unjust laws: to do away with such laws an interim constitution1 was enacted in Parliament in 1993 and became operational on 27 April 1994. It was the fundamental law of South Africa. This was later repealed by the final Constitution 2 on 4 April 1997. In its preamble it states categorically that it seeks to establish a “society based on democratic values, social justice and fundamental human rights” and “(to) lay the foundations for a democratic and open society in which government is based on the will of the people and every citizen is equally protected by law”. One of the priorities of democratic government in 1996 was the National Crime Prevention Strategy3 (hereafter referred to as the NCPS). It was designed to reduce the high level of crime in our country and has four pillars: the criminal justice process; reducing crime through environmental design; public values and education and trans-national crime. Pillar one is seen as a move away from retribution as punishment towards a system of restorative justice 4. Furthermore the South African government is a signatory to various international laws, treaties and declarations that uphold victims’ rights. One example would be the United Nations Declaration on the Basic Principle of Justice for Victims of Crime and abuse of Power 1985 - in fact the Victims’ Charter is compliant with this declaration. Yet one cannot negate the fact that in the last two decades the status of victims has altered significantly: there has been some development in the transformation of the criminal justice system. - Description: The security of its citizens is often regarded as the democratic state's primary raison d'etre. However, with increasing crime and perceptions of insecurity among citizens, along with actual and perceived state policing inadequacies, citizens around the world have sought to make alternative arrangements for their security. The explosion of private alternatives to state policing has resulted in the need for the replacement of former static definitions of policing by more fluid understandings of what policing entails. Policing is no longer an activity undertaken exclusively by the 'state police.' Policing needs to be understood within a framework which recognises the existence of a variety of state, commercial, community groups and individuals which exist within loose and sometimes informal, sometimes formal, networks to provide for the security of citizens. Preceding the country's transition to democracy in 1994 'state' policing in South Africa was aimed at monitoring and suppressing the black population and as a result it conducted itself in a largely militaristic way. When the government of national unity assumed power in 1994 it was indisputable that the South African Police had to undergo major reform if it was to play an effective, co-operative and accountable role in a democratic South Africa. While state policing has unquestionably undergone enormous changes since the advent of democracy in 1994, so too has non-state policing. It is widely accepted that the dividing line between state and non-state policing in South Africa is increasingly blurred. Policing, by its very nature, holds the potential to threaten democracy. Consequently it is important that policing is democratically controlled. According to the Law Commission of Canada four values and principles - justice, equality, accountability, and efficiency - should support policing in a democracy. This thesis is a case study of policing in Grahamstown, a small city in South Africa's Eastern Cape province. It will be shown that the policing problem that currently plagues Grahamstown, and by extension South Africa, is not simply the result of a shortage of providers but rather a problem of co-coordinating and monitoring security governance to ensure that the city does not further develop into a society where the wealthy have greater access to security than the poor.

- Description: This booklet is intended to serve as a report-back to those organisations which were party to the Conference for a Democratic Future (CDF) and to those who were unable to be present. It is also intended to act as a guide to action for 1990 and beyond. The CDF was a historic gathering of the forces for change represented by 4600 delegates from over 2100 organisations. These range form Bantustan parties on the one end of the political spectrum to ultra leftist groups on the other end. But perhaps the most significant presence was from organisations like Five Freedoms Forum, NAFCOC, the Hindu Seva Samaj, that of traditional leaders and the hundreds of other community organisations which are rapidly becoming an active component of the mass struggle for change. Also significant was the strong worker representation from a range of trade unions, including eight affiliates of NACTU whose leadership had turned down the invitation to be part of the Conference. The Conference for a Democratic Future was a major step in the overall process of building unity in action and maximising the isolation of the regime. It was, in this sense, not an isolated event. The year 1989 had taken unity in action to new heights with the Defiance Campaign and the mass marches. The process leading up to the CDF was intended td be more important then the Conference itself. Likewise, in the post-Conference period, the follow-up process should be given the importance it deserves. At the end of the day, it is this follow-up process which would determine the actual success or failure of the CDF exercise. The Declaration adopted at the Conference represents the strategic orientation of the broad forces for change. It calls for the intensification of the struggle and for the placing of the question of political power on the agenda of our united mass action. The Conference resolutions collectively contain the elements of a programme of action. Without exception, each resolution is a call to action. The task of all participants of the Conference is to translate these resolutions into Mass United Action. The adoption of the Harare Declaration should act as the starting point of a process which takes its content to the masses of our people in all comers of the country. The demand for the Constituent Assembly should become a popular demand of the people. By adopting the resolution on international pressure, the Conference sends an unambiguous signal to the world community on how the people of South Africa view their role in the struggle to end apartheid. The follow-up to the Conference should also be a continuing search for whatever common ground exists between the broad forces for change. This search must take place not only at a national level, but mere importantly at a regional and local level. The role of the international community in the South African transition: a critical review

Political parties and organisations in South Africa instead spend most of their time describing various forms of desirous IC intervention after the transition. This might explain why most articles and academic papers on 'the role of the international community' are suffixed - in the 'new South Africa' or 'post-apartheid South Africa' - few focus on the actual transition and then mostly from a systemic perspective, broadly outlining the constraints imposed by the 'new world order'. Perhaps the first serious attempt to address this gap in the debate over South Africa's future was D. Kempton and L. Mosia's 'The International Community in South Africa's Transition to non-racial Democracy' (1992). Before multiparty negotiations collapsed in June 1992, Kempton and Mosia examined the attitudes toward international intervention of most of the CODESA participants, as well as the major actors that had remained outside CODESA. This paper takes up the issue where Kempton and Mosia left off. It tries to explain transitional politics since the IC introduced an on-the-ground presence after the UN Security Council debates on South Africa in July 1992. It asks why, eight months after multiparty talks were suspended, the IC has been unable to revive multiparty negotiations, has apparently had little or no impact on the violence, and despite events like Boipatong and Bisho, still plays a minor peacekeeping role, confined to observer status. The research describes internal and external components of international intervention, examines the rationale behind the agreed forms of international participation, and assesses the viability of the internationally-supported conflict-resolution and transition-management structures that were formed to facilitate the transition. The evidence uncovered by the research leads the author to the conclusion that more of an international role is necessary, and sooner rather than later, but he concedes that this is not feasible, or likely, under the status quo.

The developmental state, social policy and social compacts: a comparative policy analysis of the South African case

- Description: The history of economic thought is ‘flooded’ with neo-classical accounts despite the fact that neoclassical economics did not occupy history alone. This has caused the discourses on ‘lost alternatives’ to be relegated as the deterministic ‘straight line’ neo-classical historical discourses are elevated. Globally hegemonic neo-classical discourse aided this phenomenon as it served to subordinate any counterhegemonic local discursive processes towards alternatives. This study is premised on the theme of non-neoclassical ‘lost alternatives’ using the post-apartheid South Africa as a case study. Emerging from the apartheid regime, the impetus towards non-neoclassical redistributive policies was strong in South Africa but this did not gain traction as the ANC’s ‘growth through redistribution’ was replaced by globally hegemonic discourse which favoured ‘redistribution through growth’. This thesis postulates the idea of two waves of ‘internal’ discursive formations; capturing the transition to democracy up to 1996 as the first wave and the period from 2005 to about 2009 as the second wave. The developmental state paradigm (DSP) emerged as the central heterodox paradigm with ideas such as industrial policy, welfare, and social dialogue/compacts being main elements. The DSP was expressly chosen in the early 1990s, the first period of strong internal discursive formation, but faded as neo-classical policies, epitomised through GEAR, dominated the policy space. The DSP discourse gained vitality in the second wave of internal discursive formation (2005-2009) and it was associated with the subsequent Zuma’s administration. The study illustrates that the DSP has failed to be fully developed into a practical framework but remained only at rhetorical level with the phrase ‘developmental state’ inserted into government policy documents and documents of ANC as a ruling party. The thesis further illustrates that the DSP fared well ideologically because of its inclination to the ideology of ‘developmentalism’ tended to trump any socialist inclined policies such as a generous welfare regime. The thesis rebuts the notion of the DSP in South Africa which has only been amorphously developed with the phrase ‘developmental state’ becoming a mere buzzword. The thesis argues that the DSP in the 21st century is much more complex and the growing ‘tertiarisation’ of the economy makes the Social Democratic Paradigm SDP’s capability centric approach much more relevant for South Africa. The study goes further to argue that a (SDP) is much more suitable alternative for addressing South African colonial/apartheid legacies and consolidation of democracy.

- Description: This thesis considers the impact which the Protection of State Information Bill will have on media freedom in South Africa. During apartheid, draconian laws prevented the media from reporting freely, and newspapers as well as the broadcast media were heavily censored. When the country became a democracy in 1994, the political grip on the media faded, and a new era of press freedom began. However, the Protection of State Information Bill is seen as a direct threat to that freedom. The Bill, also known as the Secrecy Bill, will classify state-related information and censor the media who make public or are found to be in possession of, classified information. For journalists this means that the way in which they report and what they report will be severely restricted. The Bill will also impact on the willingness of whistleblowers to come to the fore. This study looks at the importance of a free press, at how the Secrecy Bill evolved, and how opposition parties and civil society set about opposing it. It will examine democracy and its relationship with a free press, and do a policy analysis of the Bill. It will also look at how civil society organisations came together to oppose the Bill, and some of the changes which came about as a result of this opposition.

- Description: Ethnic identities in South Africa have had a particularly contrived history, set within the constraints and motivations of population classification by race. A more democratic political environment emerged with the dismantling of apartheid, bringing with it a multitude of issues including the design and character of the country’s political institutions and framework. This thesis will address two principal questions. The first and primary one investigates what lies behind the initiation and development of ethnic bonds. The second concerns the political implications and management of ethnic expressions in a democratic South Africa. An analysis of Zulu ethnic nationalism will be undertaken, because it constituted the most prominent case of assertive communal interests during democratic transitional negotiations. This thesis argues that circumstantial and instrumental factors (based on conditions, and the actions of individuals and organizations respectively), have been predominately responsible for the initiation and formation of ethnic bonds, especially amongst those who identify with a Zulu identity. The “conditions” describe the increasingly segregationist direction in which successive South African government authorities were moving, especially after the 1948 election victory of the National Party and the subsequent introduction of apartheid. Secondly, the “actions” denote the motivations of both Zulu actors and governments in generating and elaborating an ethnic discourse where their desired interests could be more effectively supported and assured. It will also be argued that because of the instrumental and selective use of ethnicity, as well as the narrow interests being served by its popular and community-centred expressions, a developing South African democratic culture should seek to protect ethnic diversity rather than promote ethnic interests. To do so would be to deny the perpetuation of ethnic cleavages and the violence and instability perpetrated in its name in recent years. The “protection” of cultural diversity is consistent with a constitution that seeks non-discrimination among all South African identities. Finally, it is believed that an emphasis on the individual as individual, as well as member of a cultural group, will break from subordinating the individual to an ascribed racial and ethnic identity as in the past, and assist in reconstituting the state as equally reflective of all South Africans.

Previously, people were not allowed to vote nor participate in making decisions that affected their lives. Organisations such as Parliament were not open and did not answer to the public. As a result, the majority of the people do not have the experience and the skills to participate in the new democracy. This places a major challenge on all those who are committed to developing democracy in the country. The growing democratic culture can only be built upon if the public participate in issues that affect them. This requires that people are made aware of what is happening in organisations like Parliament and understand how they can become involved. People need to know how to raise their concerns when decisions affecting them are being taken. Once decisions are made, the public should be informed about their rights and responsibilities and how to hold government accountable. In building a democratic culture, the right of individuals to hold differing political views must be promoted. Parliament, as a national representative body, has a responsibility to contribute to deepening the democracy we have achieved. To do this the public education programme that has been set up will: * inform people about what happens in Parliament and about democracy generally; * educate people about how Parliament and democracy work and about their rights and responsibilities; * motivate people to participate in democratic processes and engage with decision making bodies, especially Parliament; and’ * promote a culture of democracy and human rights. To achieve the above, the Public Education Department (PED) has been established to coordinate the implementation of the programme. The PED will undertake a number of activities including workshops, public meetings, the distribution of publications and audiovisuals. campaigns, outreach to the youth and educational tours of Parliament. In undertaking the programme. Parliament will work closely with Provincial Legislatures, Government Departments, civil society and the media. To consult with these agencies and to build support for the programme, a national conference will be held early next year. Prior to this conference, preparatory conferences will be held in each province. The provincial conferences will also design strategies for outreach to the different sectors within the province and plan for the implementation of joint activities. Parliament calls on all members of the public, organisations and the different sectors of society to become actively involved in the programme and the drive to deepen democracy in our country. - Description: Two of the post apartheid elections held in South Africa (1994, 1999) have been used as mechanisms to analyse and assess the extent to which the country’s transition from apartheid to a democratic dispensation is succeeding or not. The primary analytical focus of the 1994 and 1999 elections has revolved around the nature of the party system and voting behaviour. Basically, contestation has arisen over two primary and related issues: the dominance of the African National Congress (ANC) weighed against the weakness of opposition parties and the implications that this development has for effective democratic consolidation. Also, whether voting decisions based on divisive racial and ethnic identities that underlie electoral contests are pervasive enough to derail the process of democratisation. Generally, the primary conclusion has been that the unfolding pattern of South African electoral politics indicates sufficient grounds on which to doubt the prospects for effective democratic consolidation. This dissertation engages these debates with particular reference to the 2004 elections. In contrast to this pessimistic view of the prospects of successful democratisation in South Africa it upholds through an analysis of the 2004 elections the view that there is insufficient empirical evidence, to conclude that South Africa’s democratisation process is imperiled. It maintains that although there are problems related to the to the nature of the party system and some elements of voting behaviour there is enough countervailing evidence revealed by the 2004 election results that this does not present a substantially serious threat to the prospects of South Africa attaining a democratic society.

- Description: In South Africa, the right to protest is under constant threat as a result of the state response. Increasing cases of forceful policing and sometimes unlawful procedural prohibitions of protest attest to this. This study aims to firstly describe this situation through securitisation theory, essentially arguing that South Africa has become a securitised state. It also aims to understand how this is sustained by the state and why the state needs to use a securitised response to maintain power. Interviews were conducted with members of different communities and organisations. Their responses helped to illustrate the frustration of the right to protest or brutal policing during a protest. This provided primary evidence to support the claims of the study. The research shows that claims to protest are being delegitimised under the guise of security as protestors are being constructed as threats to the state. This is further substantiated by looking at how the reorganisation and remililtarisation of the South African Police perpetuates the criminalisation of protestors which necessitates a forceful response from the state. Furthermore, it shows that there is a distinct relationship between the prohibition of protest and the recent increase in ‘violent’ protests which legitimate forceful policing thereby creating a state sustained cycle of violence. The larger implication of this treatment is that these protestors are treated as non- citizens who are definitively excluded from participating in governance. In understanding why this is taking place, it is clear that a securtitised response is an attempt to maintain power by dispelling any threats to power, a response which is seen to have a long history in the African National Congress (ANC) when examining the politics of the ANC during exile. Maintaining power in this way distracts from the larger agenda of the state, which this thesis argues, is to mask the unraveling of the ANC’s hegemony and inability to maintain national unity. In other words, the increasing dissatisfaction of some of the citizenry which has manifested through protest greatly undermines the legitimacy of the government to provide for its people.

- Description: This study is a content analysis of political writings of Aggrey Klaaste (1988-2002). Six theoretical themes suggest that Klaaste’s Nation Building philosophy can help deal with racial and social divisions in the country. These historical divisions are the source of racial tensions, lack of inter-racial socialisations and cause separate living. Lack of social cohesion makes it impossible for post apartheid South Africa to achieve much-needed single national identity. The process of nation building proposed by Klaaste starts with breaking down what he refers to as ‘the corrugated iron curtain’. Social curtaining is deliberate actions by people of different racial groups, religious formations and social classes to build psychological, physical, institutional, political, economic and religious boundaries around themselves to keep others outside their living spaces. These conscious barriers result in unstable democracy as the majority (black population) get frustrated with shack dwellings - as symbols of poverty - while the white population and the middle class blacks move to white suburbs. Moving to upmarket suburbs does not necessarily make race groups to cohere and share a common national identity. Instead informal settlements breed social ills such as poverty, crime and drug substances abuse. This status quo can cause serious political instability which will affect everyone – black and white. Klaaste argues that for collective survival all race groups need to enter into politics of action. For this he proposes specific processes and actions through Nation Building. It is argued that political solutions have failed to unite people and leaders from all sectors of society should emerge. Blacks cannot moan and hate forever. Whites will be affected and must actively support the rebuilding process. This treatise proposes nation building as a process to help everyone to find uniting issues free of political ideologies to create new brotherhood and Ubuntu.

Moving to upmarket suburbs does not necessarily make race groups to cohere and share a common national identity. Instead informal settlements breed social ills such as poverty, crime and drug substances abuse. This status quo can cause serious political instability which will affect everyone – black and white. Klaaste argues that for collective survival all race groups need to enter into politics of action. For this he proposes specific processes and actions through Nation Building. It is argued that political solutions have failed to unite people and leaders from all sectors of society should emerge. Blacks cannot moan and hate forever. Whites will be affected and must actively support the rebuilding process. This treatise proposes nation building as a process to help everyone to find uniting issues free of political ideologies to create new brotherhood and Ubuntu.

- Description: Throughout South Africa’s post-Apartheid history, the ANC-led government has undertaken a distinct nation-building program in pursuit of “a truly united, democratic and prosperous South Africa” (ANC, 2007). This is reflected in a two-pronged approach, coupling political and socioeconomic transformation with the social-psychological aspect of forging a broad and inclusive national consciousness. The ANC’s “rainbow nation” approach embraces cultural diversity through what I shall call the practice of “interculturalism”. Interculturalism is a way of recognizing commonalities, reducing tensions and promoting the formation of social partnerships among different cultural groups. The ANC has also promoted a civic culture based on the principles of liberal democracy, non-racism, equality and the protection of individual rights. Interculturalism and civic nationalism are critically important factors to South African nation-building since together they foster a shared public culture and support meaningful participation in the creation of a truly just and democratic South Africa. Unfortunately, in many ways South African society remains deeply divided by race, ethnicity and economic inequality. This thesis analyses various theoretical approaches to national identity and nationbuilding with the aim of identifying several concepts which arguably throw light on the problems of South African nation-building and national identity formation. It is argued that interculturalism and civic nationalism are context appropriate approaches which have been adopted by the ANC to further an inclusive sense of shared public culture and promote participation in the creation of a shared public future. These approaches have led to the limited emergence of a broad South African national identity. However, South Africa’s commitment to socio-economic transformation has been less successful in generating widespread support for a broad national identity. While some of those previously disadvantaged under Apartheid have benefited from poverty alleviation schemes, service delivery initiatives and black economic empowerment programs, many continue to suffer from homelessness, unemployment and worsening economic conditions. Increasing economic marginalization has caused growing discontent among South Africa’s poor and constitutes the biggest threat to the formation of a cohesive national identity in South African society. Ultimately, it is argued that while interculturalism and civic nationalism have played an important role in fostering the growth of a broad national identity, true South African social cohesion will fail to emerge without a massive and sustained commitment to wide-ranging socio-economic transformation.

- Description: This thesis argues that 1994 did not mark a point of absolute discontinuity in the history of South Africa. More specifically, it asserts that 1994 did not signal the end of segregationism; instead of democracy leading to national integration, the Bantustans are still governed and managed differently from the rest of the country. Consequently, it is no surprise that they remain mired in pervasive, debilitating poverty fifteen years after 1994. In insisting that contemporary South Africa is old (rather than new), the thesis seeks to make a contribution to political struggles that aim to bring to an end the segregationist past-in-the-present. The thesis is arranged in seven chapters. The first chapter considers the crisis that has engulfed South Africa historiography since 1994. It traces the roots of the crisis back to some of the fundamentals of the discipline of history, such as empiricism, neutrality and historicism. It suggests that the way to end the crisis, to re-assert the relevance of history, is for historians to re-invoke the practice of producing histories of the present, in an interested, deliberate manner. Chapter 2 narrows down the focus of the thesis to (past and present) property. It suggests that instead of understanding the constitutional protection of property rights and installation of a restitution process as the product of a compromise between adversarial negotiators, these outcomes are more correctly understood as emanating from consensus. The third chapter outlines the implementation of the restitution programme from 1994 to 2008. The productive value of restitution over this period is found not in what it has delivered to the claimants (supposedly the beneficiaries of the programme), but rather in its discursive effects related to citizenship in the new South Africa. Chapter 4 considers the exclusion of dispossession that was implemented in the Bantustans from the restitution programme. It argues that this decision was not an oversight on the part of the post-1994 government. Instead it was consistent with all other key policy decisions taken in the recent period. The Bantustans have been treated differently from the rest of South Africa; they have been deliberately under-developed, fabricated as welfare zones, and subjected to arbitrary customary rule. Whereas Chapters 2 to 4 look at the production of historical truth on the side of domination, Chapter 6 and 7 consider production on the side of resistance. Specifically, they describe and analyse the attempts of an NGO to establish the truths of betterment as dispossession, and post-1994 prejudice against the victims of betterment dispossession. They serve as case studies of third party-led processes that seek to produce truth-effects from within a prevailing truth regime. The final chapter attempts to bring many of the threads that weave through the thesis together, by means of a critical consideration of human rights discourse. The chapter calls on intellectuals to establish truths in relation to the history of ongoing human wrongs in South Africa (as opposed to the rainbow narrative of human rights) Finally, the thesis includes a postscript, comprising technical summaries of each of the chapters.
