- Description: This study concerns the analysis of policy, and the statutory and regulatory impact of spatial planning on the land reform programme with emphasis on the land reform settlement plan (LSRP) of the Amathole District Municipality (ADM). There is a brief historical overview of the effect of the policy of spatial segregation in both rural and urban areas of the ADM. This study demonstrates, inter alia, the challenges faced by the ADM in both consolidating and physically integrating communities that were hitherto divided across racial lines. The critical question is whether the ADM has the ability to produce a Spatial Development Framework (SDF), which will be responsive to the needs of the region and serve as a catalyst in reversing the physical distortions caused by the land-planning legislation of the apartheid past. The greatest challenge lies in meeting the developmental aspirations of the Development Facilitation Act, 1995, the Local Government: Municipal Systems Act, 2000 and the National Spatial Development Perspective, 2003. Chapter 1 deals with the purpose, research problem and the method of research, as well as the definition of terms used in this research and literature review. Chapter 2 deals with the evolution of central themes of spatial planning and land reform, spatial development plans and integrated development plans (IDPs), the alignment of Amathole SDF and Eastern Cape Spatial Development Plan and the co-ordination of spatial frameworks. Chapter 3 deals with the composition of the ADM and the evolution of the LRSP, as well as land-tenure reform programmes impacting on the Amathole Municipality region. This chapter analyses the settlement plan against spatial planning legislation, the issue of institutional arrangements and mechanisms of consolidated local planning processes. Chapter 5 deals with the thorny issue of participation of traditional leaders in municipal planning and the government’s land-reform programme. Despite the existence of legislation in this regard, implementation seems to pose some difficulties. This chapter also deals with the co-operative governance framework. Chapter 6 is a concluding chapter dealing with the gaps discovered in the Amathole Municipality in the light of existing legislation. Reference to cases is made to demonstrate the challenges confronting the ADM. One notable aspect is the issue of urban-rural dichotomy and how the two worlds are positioned in their competition for the use of space. It is evident from this research that the post-1994 policy and legislative framework and implementation machinery lacks capacity to change the current form of the apartheid city-planning paradigm, something which impacts immensely on the sustainability of the current human-settlement development programmes. Population dynamics in terms of migration are hugely driven by search for employment opportunities and better services. The efficiency and ability of the municipal spatial evelopment frameworks in directing and dictating the identification of development nodes in its juristic boundary informed by the overarching national policy and legislative framework is key in building a better South Africa.

Tourism is one of the most important sectors of the economy and an extremely lucrative business. The industry is growing and carries great potential of contributing to a country and/or local areas’ economy and development. What motivated the study is that there are no published studies on the contribution of tourism to LED in BCMM. Therefore, is a lack of information on the importance of tourism activities on promoting the local communities’ economies and social well-being by helping to reduce poverty. Even though, the municipality gives some information on activities that are being done by the municipality to work with the local communities that have tourist attraction hubs, the information does not delve into economic issues that are needed to ensure that there is promotion of development in areas that are around the tourist attraction hubs. The study was qualitative and it used secondary data to achieve its objectives. Data was sourced from journals, municipal documents, newspapers and many other secondary sources. Results showed that tourism in BCCM has led to economic development in that there are quite a number of attractions and tourism products in the city i.e. museums, theatres, beautiful beaches, conference, restaurants, and accommodation facilities, and this is where job opportunities are created. The tourism sector is one of the key areas with great potential for poverty alleviation and has been taken as a key portfolio to be appropriately monitored to foster its growth and development in the Buffalo City Metropolitan.

The study is based on the assumption that O R Tambo District Municipality, like any other municipality in South Africa, particularly in the Eastern Cape, is confronted with the implementation challenges of performance monitoring and evaluation. ORTDM has a performance-management system that is not fully implemented, and needs to put into context its challenges, in order to appropriately make those interventions relevant to the situation. The fact that the performance- management system has not yet been cascaded to the lower level employees creates difficulties in performance monitoring and evaluation. There has been a deep concern that municipalities are underperforming, and yet with no visible steps being taken to improve the situation. If the O R Tambo District Municipality is attempting to achieve the objectives of the local government, as stated in the Constitution of the Republic of South Africa, 1996, it is then necessary to properly implement performance monitoring and evaluation, as mechanisms to accelerate service delivery. This has the potential to improve the quality of life of the citizens of O R Tambo District Municipality. This study provides the general background to the implementation challenges of performance monitoring and evaluation in the O R Tambo District Municipality. The challenges of performance monitoring and evaluation, the determinants of performance monitoring and evaluation, as well as the theories used in performance monitoring and evaluation will be addressed. The study presents the findings resulting from the analysis of the data provided by the respondents. Amongst the findings of the study there is a view that the O R Tambo District Municipality does not have monitoring and evaluation specialists who could ensure that performance is being periodically evaluated, in order to close policy gaps that might be in existence. Non-involvement or partial involvement of communities has the potential to cause stagnation, as people generally lack monitoring skills. Some of the ecommendations include: the skills development of all the stakeholders, especially those with the mandate to deliver on behalf of government, that is, political office bearers, together with the technical support wing. Performance monitoring and evaluation under the proposed recommendations could be enhanced and positive changes could be realised.

Also, the report by the Co-operative Governance and Traditional Affairs in 2009 indicated that Amahlathi local municipality is among 57 municipalities in the country that have been identified as the most vulnerable and which therefore needed support for sustenance. This study details these challenges and places particular focus on the utilisation of the IDP as a developmental tool for Amahlathi Local Municipality. From the literature and responses by the respondents, it is clear that local government has to be committed to work with citizens and groups within the communities to find sustainable ways to meet their social, economic and material needs and improve their quality of life. The study is both qualitative and quantitative and questionnaires have been used as a method of collecting data. The responses and results suggested that the community members in the Amahlathi municipality were aware of the existence of the IDP. However, a lot of work still has to be done to ensure that there is development in the communities.

The study argues that without its proper implementation, service cannot be rendered effectively and efficiently.The research findings also point out the need for sensitizing the community about the need to participate in the affairs of their development so that the IDP can be a true reflection of their needs. The mantra of this research is effective service delivery through the implementation of the IDP.

- Description: The Republic of South Africa became a democratic country in 1994 after the historic democratic elections. This year also marks the year when South Africa’s first democratic parliament was convened. The Constitution of the Republic of South Africa Act (no. 108 of 1996) was enacted in 1996. This Constitution provides for the creation of the three spheres of government, namely, the national level, which deals with matters of national importance, the provincial level, which deals with matters of provincial importance, and the local level which deals with matters of local importance. Section 152(1) (e) of the above-mentioned Constitution stipulates that the object of local government, amongst others, is to ensure the involvement of communities and community organizations in the matters of local governance. Section 73 of the Municipal Structures Act (no.117 of 1998) also requires municipalities to establish ward committees in a manner that seeks to enhance participatory democracy at the local level. Municipalities are established in terms of Section 12 of the Municipal Structures Act (no. 117 of 1998), wherein Members of Executive Councils (MEC’s) may, by notice in the Provincial Gazette, establish a municipality in each municipal area which the Demarcation Board demarcates in the province in terms of the Municipal Demarcation Act (no. 27 of 1998). Sections 7 and 8 of the Municipal Structures Act (no. 117 of 1998) further stipulate the categories of municipalities as A, B and C. Category A is a metropolitan municipality with wards and ward committees. B is a local municipality characterized by the existence of wards and ward committees to enhance public participation. C is a district municipality, whose responsibility is to support local municipalities within its area of jurisdiction so that they are self sufficient and can manage their own affairs. This study focuses on the Kouga Local Municipality, which is a Category B Municipality as promulgated by the then MEC for Housing, Local Government and Traditional Affairs, Honourable MEC S. Kwelita in the Provincial Gazette (Gazette No. 1537) dated 23 May 2006. The scenario above indicates that in the Kouga Local Municipality, ward committees are supposed to play a critical role in public participation. The study seeks to assess their role and to establish whether or not the ward committee system is effective in this regard. It is common knowledge that, whilst various pieces of legislation are clear in terms of what the role of ward committees should be, the question remains whether there is any adherence in municipalities to ensure that they fulfill their role in public participation, and hence the study.

- Description: The Republic of South Africa became a democratic country in 1994 after the historic democratic elections. This year also marks the year when South Africa’s first democratic parliament was convened. The Constitution of the Republic of South Africa Act (no. 108 of 1996) was enacted in 1996. This Constitution provides for the creation of the three spheres of government, namely, the national level, which deals with matters of national importance, the provincial level, which deals with matters of provincial importance, and the local level which deals with matters of local importance. Section 152(1) (e) of the above-mentioned Constitution stipulates that the object of local government, amongst others, is to ensure the involvement of communities and community organizations in the matters of local governance. Section 73 of the Municipal Structures Act (no.117 of 1998) also requires municipalities to establish ward committees in a manner that seeks to enhance participatory democracy at the local level. Municipalities are established in terms of Section 12 of the Municipal Structures Act (no. 117 of 1998), wherein Members of Executive Councils (MEC’s) may, by notice in the Provincial Gazette, establish a municipality in each municipal area which the Demarcation Board demarcates in the province in terms of the Municipal Demarcation Act (no. 27 of 1998). Sections 7 and 8 of the Municipal Structures Act (no. 117 of 1998) further stipulate the categories of municipalities as A, B and C. Category A is a metropolitan municipality with wards and ward committees. B is a local municipality characterized by the existence of wards and ward committees to enhance public participation. C is a district municipality, whose responsibility is to support local municipalities within its area of jurisdiction so that they are self sufficient and can manage their own affairs. This study focuses on the Kouga Local Municipality, which is a Category B Municipality as promulgated by the then MEC for Housing, Local Government and Traditional Affairs, Honourable MEC S. Kwelita in the Provincial Gazette (Gazette No. 1537) dated 23 May 2006. The scenario above indicates that in the Kouga Local Municipality, ward committees are supposed to play a critical role in public participation. The study seeks to assess their role and to establish whether or not the ward committee system is effective in this regard. It is common knowledge that, whilst various pieces of legislation are clear in terms of what the role of ward committees should be, the question remains whether there is any adherence in municipalities to ensure that they fulfill their role in public participation, and hence the study.

As a key developmental agent, local government is obliged by the Constitution of the Republic of South Africa 1996 to develop a culture of municipal governance that encourage and create conditions for the local community to participate in the affairs of the municipality. In this regard, ward committees have been introduced to municipalities as community structures to play a critical role in linking and informing the municipalities about the needs, aspirations and problems of their communities. In adherence to national legislation, such as the Local Government: Municipal Structures Act 117 (Act117 of 1998) and the Local Government: Municipal Systems Act 2000 (Act 32 of 2000) Nkonkobe Local Municipality established advisory structures in the form of ward committees throughout its area of jurisdiction to advise the municipal council on any matter within the council’s competence. As a representative structure of the community the ward committee is expected to serve as a link between the council and the community and for this purpose articulates community needs and aspirations to better the living standards of the community. Despite the stated objectives of ward committees, the Middledrift area has been identified by Nkonkobe Local Municipality IDP: 2007-2012 as the poorest area in Nkonkobe municipality with backlogs in infrastructure and service delivery. People are attracted to the coast because of access to resources, favourable climate, aesthetic appeal and potential for recreational activities. As pressure for utilisation and development increases, so does the need to manage the coastal system more effectively. This research focuses on the coastal zone of the Ndlambe and Ngqushwa local municipalities in the Eastern Cape, South Africa, which are physically and environmentally similar, yet have distinct demographic and socio-economic differences. The research integrates information using GIS, from three time epochs, to determine where development and land use change is occurring. The Ndlambe Local Municipality displays high levels of formal development, while the Ngqushwa Local Municipality exhibits little formal development. These differences in development and land use are related to economic, social and legislative ‘drivers’ based on an adapted Driver-Pressure-State- Impact-Response model. The model identifies that development and land use changes lead to increased pressure on the natural system, which in turn leads to shifts in the natural state of the coastal zone, resulting in adverse impacts on the coastal zone. Changes in the natural functioning of the coastal zone highlight the need for a response in terms of changes in legislation governing coastal management and spatial planning. This research concludes that pressure for development in the coastal zone within the research site is beginning to increase and will adversely affect the coastal zone if not managed effectively. These two local municipalities have the opportunity to move forward and develop in such a way that allows for conservation and sound management of the coastal zone, which will ensure long-term sustainability within the coastal zones of the Ndlambe and Ngqushwa local municipalities

These allegations include poor governance, maladministration, corruption and poor delivery of services. Certain municipalities are unable to deliver sufficient services to the communities of their geographic areas due to maladministration, political interference and corruption. This study undertook an assessment of the implementation of the Local Government Turnaround Strategy with emphasis on the Umzimvubu Local Municipality. The study comprises of five chapters and was motivated by the National Cabinet‟s decision to turn around the image of South African municipalities. The study includes an overview on the development and transformation of local government in South Africa as a point of departure. - Description: Local government in South Africa has undergone radical changes since the first democratic local government elections were held in 1995 and 1996. It is generally known that local government in South Africa was based on racial fragmentation. The new South Africa therefore has to go beyond purely representative democracy to address the inequalities of the apartheid era. The Constitution of the Republic of South Africa Act, 1996 (Act 108 of 1996), envisages a complete transformation of the local government system. Subsequently, a policy framework has been developed to give effect to a new vision of local government. The White Paper on Local Government was passed in March 1998. It spells out the framework and programme in terms of which the existing local government system will be radically transformed. This culminated in the birth of the concept of developmental local government. Developmental local government establishes the basis of a system of local government which is centrally concerned with working with local citizens and ward communities in particular to find sustainable ways to meet their needs and improve the quality of their lives. Developmental local government encourages public participation at the local level. One of the most powerful instruments by which the communities and groups become involved in local government affairs is through the ward committee structures and ward planning forums. The Municipal Systems Act, 2000 (Act 32 of 2000), makes provision for community participation. Ward committees are established in terms of section 17 (1) of the Municipal Structures Act, 1998 (Act 117 of 1998). Ward committees play an important role in creating a democratic culture of local participation and accountability. They are the main mechanisms available to municipalities and communities to enhance public participation in ix the local sphere of government. Their major obstacle is that their powers are limited to advising the communities and the relevant council. The White Paper on Local Government provides for three approaches which can assist municipalities to be more developmental, namely integrated development planning and budgeting, performance management and working together with local citizens. Ward committees provide a link between the council and these processes. The new system of local government also provides for the consideration of gender issues at the ward committee level. The local government policy framework requires that at least fifty percent of representation on ward committees should be women. The involvement of youth is also greatly encouraged. The system also provides for and clarifies the role/relationship with traditional leaders at the ward committee level. The local government legislative framework accepts and acknowledges the existence of traditional leaders. Their involvement in ward community activities and functions is well documented. Lastly, the capacity building of ward committees is posing a major challenge. In order for ward committee members to perform their functions effectively training must be provided. The respective local councils should be responsible for providing the necessary training to ward committees through the office of the speaker under which they fall. In the national sphere efforts are made to ensure that training for ward committees is provided.

- Description: This study analyses the effectiveness of community participation in service delivery. The area of study, the Chris Ham District Municipality (CHDM), is a Water Services Authority, responsible for ensuring access to water services (water and sanitation) by all communities within its jurisdiction. There are eight local municipalities within the CHDM. The objective of this study is to determine whether systems are in place in local government to promote participation by communities in service delivery projects and whether these systems are being utilised efficiently by the role-players concerned. The role-players in this research are people who are involved in community development programmes of the municipality (municipal staff in the relevant departments of the municipalities under study, the social facilitators, civil society organisations, ward committees, ward councillors, traditional authorities as well as the representatives of communities (Project Steering Committees) who are beneficiaries of the projects under study). The projects that are under study were selected from a readily available list of CHDM capital projects that appear in the 2003/2004 financial year funding plan and are running. The findings of the study at both levels (local and district) show that the municipal environment is not conducive to promoting community participation. This is linked to factors such as the structural arrangements, whereby the offices relevant for promoting community participation are not fully occupied, which provided evidence that community participation is not prioritised. There is lack of coordination of programmes within the local government spheres as well within departments of the DM and strategies for community participation have been found to be non-effective. At project level lack of community participation is linked to the utilisation of ward committees as the only mechanism for community participation regardless of its un-equal and party biased representation. This study therefore concludes that although the systems to promote community participation are in place, they are not effective.

The projects that are under study were selected from a readily available list of CHDM capital projects that appear in the 2003/2004 financial year funding plan and are running. The findings of the study at both levels (local and district) show that the municipal environment is not conducive to promoting community participation. This is linked to factors such as the structural arrangements, whereby the offices relevant for promoting community participation are not fully occupied, which provided evidence that community participation is not prioritised. There is lack of coordination of programmes within the local government spheres as well within departments of the DM and strategies for community participation have been found to be non-effective. At project level lack of community participation is linked to the utilisation of ward committees as the only mechanism for community participation regardless of its un-equal and party biased representation. This study therefore concludes that although the systems to promote community participation are in place, they are not effective.

The advent of democracy in 1994 brought about a number of legislative reforms aimed at addressing the injustices that were imposed by the colonial and apartheid governments on the African people. At the forefront of these legislative efforts was the restoration of land to the original inhabitants of the country. Research indicates that, since 1994, the South African government has issued out land to different individuals and communities around the country in an attempt to address structural unemployment and poverty that plague the country. Using the Sustainable Livelihoods Theoretical framework, this study sought to examine the experiences of land reform beneficiaries in the Makana Municipal district of the Eastern Cape, in order to determine the extent to which the transfer of land to landless people has met the governments’ agenda to alleviate poverty and unemployment in the rural regions of South Africa. The findings in this study show that, successful land reform in South Africa is hindered mostly by two factors. Firstly, the inability of land beneficiaries to access quality education, skills training, finances and formal agricultural value chains. Secondly, land beneficiaries are further placed at a disadvantage by the poor quality of public services in their local municipalities and inconsistent post-settlement support from the state. The conclusion made in this study, is that the government has to be cognizant of the aforementioned structural barriers, when designing and rolling out land reform projects throughout the country. Failure to address these glaring structural barriers, will result in the creation of a peasant class of people living on underutilized land.

- Description: The need to achieve developmental local government in South Africa has necessitated that the municipalities and other government departments pay more attention to the poor so that they can be helped to live more fruitful lives and become the instruments for the growth of local economy. This study seeks to assess the impact of Local Economic Development (LED) initiatives in Mbhashe Local Municipality with special focus on the Maize Production Project (MPP). The areas of Mbhashe municipality that were included in the study include Ndakeni village near Dutywa, Tswele-litye near Willowvale and Madwaleni near Elliotdale. The study followed both the qualitative and quantitative research approaches and the respondents were made up of a sample of MPP beneficiaries from the three areas mentioned above, Community Leaders and the Officials. The objectives of the study were to identify MPP objectives, to identify challenges in the implementation of the MPP, to assess the availability of remedial measures and lastly, to assess whether the community has benefited from the maize production project or not. Among others, the objectives of the MPP were to maximise maize production, to make profit, to create employment opportunities for the unemployed. Only 13 percent of the surveyed beneficiaries believe that their expectations of this initiative were fully met. The majority (two thirds) believe that their expectations were partly met, whilst one in five (20 percent) believe that their expectations were not met at all. The MPP implementation challenges included delays caused by the municipal procurement processes, unfavourable climate conditions, poor service delivery by the appointed service providers who provide tractors, shortage of funds and late start for ploughing. Even though the remedial measures seem to be in place, the implementation and the communication of the strategies remains a big challenge. Furthermore a proportion of the respondents were unhappy with the public participation process that preceded the implementation of the project.According to the findings, two thirds (67 percent) of the surveyed farmers believe that their communities have benefited from the MPP, although one third (33 percent) disagreed. The challenges of an insufficient budget, procurement delays and late commencement of ploughing need to be addressed if the maize production initiative is to yield the desired results.

- Description: The participation of communities and community organizations in Municipal governance is set in terms of the law as a mechanism to deepen democracy. Municipalities are required to develop a culture of governance that complements representative democracy with community participation. However the participation of communities in local governance has not translated to the strengthening of governance and the deepening of democracy as municipalities have not done enough to involve communities in municipal affaires. Lack of human resources, and financial capacity have been cited as some of the reasons that beset municipalities and undermine citizen participation. Municipalities have taken steps to encourage community participation and these include establishment of structures to enable participation, however without the guidance and financial support of the municipalities these structures are not able to perform their functions. In spite of all the efforts made by municipalities to encourage participation, a culture of community participation has not yet taken root in local government. While the legislative framework provides for communities to participate, practice shows that the implementation of legislation is complex and requires dedicated capacities within the councils to be effective. This can be achieved when municipalities develop their own community participation policies which address their special circumstances, which must be reviewed on a regular basis. Unless communities are empowered with knowledge on the available participation mechanisms, the dream of a culture of participation will remain just that, a dream. Thus civic education coupled with capacity building of officials will assist in ensuring the development of a culture of participation. Council must also develop mechanisms to evaluate the effectiveness of community participation processes and procedures, to avoid a one size fits all approach. It is imperative that councils as the legislative arm of municipalities must lead the process and not leave everything to the executive arm.

The purpose of this study was to investigate what causes tensions in the relationship between traditional leaders and ward Councillors and also how can it be managed and or be improved as it affects production in service delivery and development. Furthermore, the study seeks to find ways through which the relationship between traditional leaders and ward Councillors could be managed to harmonize the relationship between them in order to improve service delivery in Mnquma Local Municipality. Most municipalities which are based in rural areas in South Africa are faced with a lot of challenges which has left development staggering and thus in long run inefficiency in service delivery is caused. As a result of poor service delivery Mnquma Municipality is faced with the challenge of instability towards its management, whereby several Mayors have been chased away through protests, as result service delivery has been hampered and delayed. These challenges are the results of the poor relationship between traditional leaders and ward Councillors over land ownership, control and authority of resources for development. The legislations that govern traditional leaders are ambiguous or rather vague when it comes to their roles and functions in development and service delivery in the new democratic government of South Africa and thus cause the traditional leaders to feel that they are undermined by the ward Councillors whom according to traditional leaders feel they that ward Councillors are more recognized than them. It is in this context that this study seeks to investigate the causes of conflict between the traditional leaders and ward Councillors and how the conflict impacts on service delivery and development and also can it resolved to harmonize the situation. The researcher used a qualitative method to collect data, the questionnaires and interviews were conducted to Municipalities, Traditional Leaders, Municipal Managers, Ward Councillors, Ward Committees and the community. Data was collected and analysed using descriptive method. The researcher came out with the following summary of the findings: The management of relationship between traditional leaders and ward Councillors over ownership of projects, control, land distribution and authority is very poor. Traditional leaders felt that the present democratic government has given too much power to the ward Councillors for most development programs. There is no absolute proper consultation of traditional leaders by neither local government officials, municipalities and ward Councillors before any development is done in their areas. Poor recognition of traditional leaders by ward Councillors and other politicians. There is allegation by the community members and traditional leaders that ward Councillors are bias in delivering services, preference is given to the group that belongs to their party of interest. When there is development projects employment opportunity is not given to the local communities of that area. Traditional leaders are not allowed to actively participate in council meetings.

Mainly, an ethnographic approach was used; it involved embracing participant observation in the ADM offices for approximately 6 months. As the researcher, I participated as one of the ADM’s officers in different activities, namely: attending meetings and one workshop, and accompanying the development officer while conducting an observation of various projects in Butterworth. The findings in the study disclose that the disjuncture between policy planning and implementation may be attributed to 4 factors, which are associated with the ADM office as the development agency for the Amathole region. These are: the incapability to respond to policy implementation complexities, failure to exploit policy implementation complexities as learning opportunities, the insufficient understanding of ‘process monitoring’ as a tool that could be integrated in projects management, as well as the execution of policy implementation in the absence of policy documents as a guide in implementation processes. Moreover, these factors are examined as being related to each other, and they will be discussed in detail in the course of the thesis.
